Contents of the Entrustment Agreement of the Local Development Investment Fund
According to Clause 2, Article 32 of Decree 147/2020/ND-CP (Effective from February 5, 2021), the content is prescribed as follows:
The acceptance of entrusted investment by a local development investment fund is conducted based on the decision of the provincial People's Committee or an entrustment contract signed between the Fund and the entrusting organization or individual. The decision/entrustment contract includes the following basic contents:
- Name, address, legal status, legal representative of the entrusting party (if any) and the entrusted party (local development investment fund).
- Purpose of entrustment; content of entrustment.
- Entrusted capital amount; entrustment term; entrustment cost.
- Beneficiaries; responsibilities for appraisal and supervision of entrustment activities; responsibilities for risk handling of the entrusting party.
- Rights and obligations of the parties; handling cases of premature termination of the entrustment document; clauses on handling violations (if any).
- Other contents as agreed upon by the parties in compliance with legal regulations.
