Allocation of Official Development Assistance (ODA) Funds for the Capital City of Hanoi

Allocation of Official Development Assistance (ODA) funding for the capital city of Hanoi is stipulated in Article 8 of Decree 63/2017/ND-CP, which outlines the specific financial and budgetary mechanisms and policies applicable to the capital city of Hanoi, as follows:
The Government of Vietnam prioritizes the allocation of Official Development Assistance (ODA) and other concessional loan sources to the city of Hanoi to invest in programs and projects for the construction of urban technical infrastructure systems, the environment, and social welfare.
The allocation of investment capital for programs and projects using ODA funds and other concessional loan sources within the City's jurisdiction is carried out according to the principles: For programs and projects funded by the Hanoi city budget, the Government of Vietnam shall lend or partially grant under legal provisions. The City is responsible for arranging counterpart funds from the city's budget to implement and repay the principal and interest of the borrowed portion fully and on time as per legal regulations.
The specific allocation level for ODA or other concessional loan sources from the Government of Vietnam for programs and projects for the City according to the provisions in Clause 2 of this Article shall be executed based on the City's proposals, the opinions of the Ministry of Planning and Investment, and the Ministry of Finance. The Government of Vietnam shall balance within the annual state budget estimates presented to the National Assembly for decision-making as prescribed by the Law on State Budget and the Law on Public Investment.
The Hanoi City People's Committee is authorized to approve the project list, and decide on the acceptance of non-refundable grants (ODA, non-Government of Vietnam foreign) for programs and projects irrespective of the grant size, except for technical assistance grants related to religious institutions, legal policy, administrative reform, defense, and security as decided by the Prime Minister of the Government of Vietnam. The City People's Committee is responsible for effectively receiving, managing, and utilizing these grants, implementing accounting and settlement policies as conformable by law; periodically reporting to the Ministry of Finance and the Ministry of Planning and Investment for monitoring, supervision, and compiling reports for the Prime Minister of the Government of Vietnam.
