What is a secondary label for goods?
The secondary label for goods is defined in Clause 4, Article 3 of Decree 43/2017/ND-CP on goods labeling as follows:
A secondary label is a label showing the mandatory contents translated from the original foreign language label of goods into Vietnamese and supplemented with the mandatory contents in Vietnamese according to the laws of Vietnam that the original label of goods lacks;
The above is the definition of a secondary label for goods. To understand this issue more clearly, you should refer to Decree 43/2017/ND-CP.
Does imported goods from South Korea need to have a secondary label on the product?
Based on the provisions in Clause 4, Article 3 of Decree 43/2017/ND-CP on goods labeling, it is stipulated:
A secondary label is a label showing the mandatory contents translated from the original foreign language label of goods into Vietnamese and supplemented with the mandatory contents in Vietnamese according to the laws of Vietnam that the original label of goods lacks;
And in Clause 3, Article 7 of Decree 43/2017/ND-CP on goods labeling, it is stipulated:
Goods imported into Vietnam, which the label does not display or inadequately displays the mandatory contents in Vietnamese, must have a secondary label showing the mandatory contents in Vietnamese and must retain the original label of goods. The content written in Vietnamese must correspond to the content written on the original label.
Thus, according to the current regulations, goods imported into Vietnam (from Korea-Vietnam) that have not displayed or inadequately displayed the contents in Vietnamese are required to have a secondary label displaying the contents in Vietnamese.
Contents of the secondary label on imported products?
In Clause 4, Article 8 of Decree 43/2017/ND-CP on goods labeling, it is stipulated:
The contents written on the secondary label are translated verbatim into Vietnamese from the mandatory contents written on the original label and supplemented with other mandatory contents as per the nature of the goods according to this Decree. The organization or individual labeling must take responsibility for the accuracy and truthfulness of the labeled contents. The contents written on the secondary label, including the supplementary contents, must not misinterpret the contents on the original label and must accurately reflect the nature and origin of the goods.
For goods that cannot be exported or are returned and circulated in the market, the secondary label must bear the bold words "Produced in Vietnam."
Thus, according to the above regulations, whatever contents are on the imported goods’ label must be translated into Vietnamese for the secondary label. Additionally, missing mandatory contents according to the nature of the goods must be supplemented according to Appendix 1 of Decree 43/2017/ND-CP.
