What criterias must be met in order to become a member of the Vietnam Association for the Protection of Film and Television Rights?

Pursuant to Article 8 of the Charter of the Association for Protection of the Rights of Film and Television Films in Vietnam promulgated together with the Decision 840/QD-BNV in 2021 stipulating as follows:

Members of the Association include: official members and honorary members.

1. Official member:

a) Organizational members: Vietnamese organizations established in accordance with the law operating in the field of protecting the rights of authors and copyright holders with respect to Vietnamese cinematographic works and television series agreeing to the Association's Charter, voluntarily joining the Association, can become an official member of the Association. Each member being an organization has one legal representative to join the Association. The representative of an organization's members must be the legal representative of that organization and a Vietnamese citizen;

b) Individual members: Vietnamese citizens who are active or engaged in activities related to the field of copyright protection, copyright holders for Vietnamese cinematographic works and television series. become the Association's Charter, voluntarily join the Association, can become an official member of the Association.

2. Honorary members: Vietnamese citizens and organizations that do not have conditions or are not qualified to be an official member of the Association but have contributed to the development of the Association, agreeing to the Association's Charter, which is considered by the Association and recognized as an honorary member of the Association.

According to the above regulations, members of the Vietnam Association for the Protection of Film and Television Rights include: official members and honorary members.

Regarding the criteria to become a member of the Association, it is necessary to meet the criteria in Article 8 above.

What are rights and obligations of members of the Vietnam Association for the Protection of Film and Television Rights?

Pursuant to Article 9 of the Charter of the Association for Protection of the Rights of Film and Television Films in Vietnam promulgated together with the Decision 840/QD-BNV in 2021 stipulating as follows:

* About the rights of members

- Have their legitimate rights and interests protected by the Association in accordance with law.

- Be provided with information related to the activities of the Association by the Association, to participate in activities organized by the Association.

- Participate in discussions and giving opinions on the policies and directions of the Association's activities; is recommended to propose opinions to the competent authority on issues related to the field of operation of the Association.

- Participate in discussions, to propose opinions and to decide on the working guidelines of the Association according to the provisions of the Association's Charter; to propose and give opinions to the competent authority on issues related to the field of operation of the Association in accordance with the law.

- Attend the General Meeting, stand for election, nominate and elect agencies, leadership positions and the Association's Inspection Committee in accordance with the Association's regulations.

- Introduced new members.

- Be rewarded according to the regulations of the Association.

- Issuance of membership card.

- Leave the Association when it is deemed that it is impossible to continue being a member.

- Honorary members enjoy the same rights and obligations as official members, except for the right to vote on matters of the Association and the right to stand for election, nominate, and nominate the Executive Board and the Association's Inspection Committee.

* About the obligations of members

- Strictly abide by the guidelines and lines of the Party, policies and laws of the State and the Association's Charter and regulations.

- Participate in activities and activities of the Association; unite and cooperate with other members to build a strong association.

- Protect the reputation of the Association, not on behalf of the Association in transaction relationships, unless assigned in writing by the leader of the Association.

- Implement the information and reporting regime in accordance with the Association's regulations.

- Pay membership fees in full and on time according to the Association's regulations.

What are procedures for admission of members of the Vietnam Association for the Protection of Film and Television Rights?

Pursuant to Article 11 of the Charter of the Association for Protection of the Rights of Film and Television Films in Vietnam promulgated together with the Decision 840/QD-BNV in 2021 stipulating procedures for admission of members of the Vietnam Association for the Protection of Film and Television Rights as follows:

Step 1: Conditions for joining the Association: Vietnamese organizations and citizens who meet the criteria as prescribed in Article 8 of the Charter issued together with Decision 840/QD-BNV must write an application to join the Association, enclosed with an application. Dossier to join the Association, including:

- Application to join the Association;

- A copy of the business registration certificate (for organizational members);

- Declaration of joining the Association (according to the form prescribed by the Standing Board of the Association).

Step 2: According to the Executive Board's resolution, the Association's President makes a decision to recognize new members.

Step 3: After receiving the decision to admit a member of the Association Executive Board, the member pays the prescribed membership fee and is granted a membership card of the Association.

- The Association's Executive Board shall specify the process and procedures for admission and withdrawal of members from the Association in accordance with the Association's Charter and the provisions of law.
