Based on Article 27 of Decree 131/2013/ND-CP, as amended and replaced by Clause 2, Article 3 of Decree 28/2017/ND-CP, regarding acts of infringement on the rights to copy audio and video recordings, as follows:
A fine ranging from 15,000,000 VND to 35,000,000 VND shall be imposed for the act of copying audio and video recordings without the permission of the rights owner or the producer of the recordings.
Remedial measures:
Required removal of the copied audio and video recordings in electronic form, from online and digital environments, or required destruction of the infringing material for the act specified in Clause 1 of this Article.
Thus, the act of copying music videos from discs without the consent of the rights owner or the producer will be fined from 15,000,000 VND to 35,000,000 VND. Measures to rectify the violation must be carried out as stipulated above.
Posting Copied Music Videos Without the Producer's Consent: What Are the Penalties?
According to the provisions of Article 28 of Decree 131/2013/ND-CP, as amended and replaced by Clause 2, Article 3 of Decree 28/2017/ND-CP, regarding acts of infringement on the rights to distribute the original or copies of audio and video recordings to the public, as follows:
A fine ranging from 10,000,000 VND to 30,000,000 VND shall be imposed for the act of distributing to the public the original or copies of audio and video recordings without the permission of the rights owner or the producer of the recordings.
Remedial measures:
Required removal of the copied audio and video recordings in electronic form, from online and digital environments, or required destruction of the infringing material for the act specified in Clause 1 of this Article.
Thus, the act of posting copied music videos from discs online without the consent of the rights owner or the producer will be fined from 10,000,000 VND to 30,000,000 VND. The copied audio and video recordings in electronic form must be removed from online and digital environments or the infringing material must be destroyed.
