Pursuant to the Appendix issued together with Circular 04/2024/TT-BTP stipulating the form for death declaration:

Notes:
(1) Clearly state the name of the death declaration authority.
(2) Only fill if the person requesting civil status registration does not have/provide a personal identification number/citizen ID/card or ID card; does not provide full information on date of birth.
In case "Place of residence" information is required, state the registered permanent residence; if there is no permanent residence, then state the temporary residence; if neither is available, state the current residence.
(3) Record the personal identification number/citizen ID/card (e.g., Citizen ID No. 025188001010 issued by the Department of Police Administration on Social Order on November 20, 2021). If there is no personal identification number/citizen ID/card, record an acceptable substitute document (passport, ID card, etc.).
(4) If referring to the Death Report, cross out the phrase "Substitute document for Death Report"; if using the Substitute document for Death Report number, specify the name, number of the document, and cross out "Death Report"; if not available, leave this field blank.
(5) Please mark an X in the box if a copy is requested and specify the quantity.

What is the place for declaration of death for foreigners who die in Vietnam?
Based on Article 51 of the Law on Civil Status 2014 stipulating authority for death declaration:
Article 51. Authority for death declaration
The district-level People's Committee of the last place of residence of the deceased conducts death declaration for foreigners or Vietnamese citizens residing overseas who die in Vietnam.
If the last place of residence of the deceased cannot be determined according to Clause 1 of this Article, the district-level People's Committee of the place where the person died or where the body was discovered shall conduct the death declaration.
According to the above provision, the authority for death declaration for foreigners who die in Vietnam is the district-level People's Committee of the last place of residence of the deceased.

What are procedures for death declaration for foreigners who die in Vietnam?
Based on Article 52 of the Law on Civil Status 2014 stipulating the procedure for death declaration:
Article 52. Procedure for death declaration
The person registering the death submits the declaration form according to the prescribed form and the Death Report or other documents replacing the Death Report to the civil status registration authority.
Immediately after receiving the documents as prescribed in Clause 1 of this Article, if the death declaration is found to be correct, the official responsible for civil status records it in the Civil Status Register and signs it together with the person registering the death. The Judicial Division reports to the Chairman of the district-level People's Committee to issue a civil status extract for the person registering the death.
If verification is necessary, the resolution time shall not exceed 03 working days.
- After registering the death, the district-level People's Committee must notify in writing accompanied by the civil status extract to the Ministry of Foreign Affairs for notification to the competent authority of the country of which the deceased was a citizen.
If the deceased is a Vietnamese citizen residing overseas, the official responsible for civil status locks the deceased's information in the electronic civil status database.
According to the above provisions, the procedure for death declaration for foreigners who die in Vietnam is carried out as follows:
Step 1: Submit documents
The person registering the death submits the documents to the civil status registration authority. The death declaration file includes the following documents:
- death declaration declaration form
- Death Report or other documents replacing the Death Report issued by the following competent authorities:
+ For deaths at medical facilities, the Head of the medical facility issues;
+ For deaths by execution, the Chairman of the Execution Council issues;
+ For those declared dead by the court, the court issues;
+ For deaths on transport vehicles, the police authority issues;
+ For deaths due to accidents, homicides, sudden deaths, or suspicious deaths, the forensic examination agency issues;
+ For deaths not falling into the above categories, the commune-level People's Committee of the place the person died issues;
Step 2: The civil status official receives and checks the documents
Step 3: The civil status official records in the Civil Status Register if the death declaration is correct
Step 4: The civil status official signs the Civil Status Register with the person registering the death.
Step 5: The Judicial Division reports to the Chairman of the district-level People's Committee to issue a civil status extract for the person registering the death.
Step 6: The district-level People's Committee notifies, along with the civil status extract, the Ministry of Foreign Affairs to inform the competent authority of the country of which the deceased was a citizen.
