What are cases of revocation of passports in Vietnam?

Pursuant to Article 27 of the Law on Entry and Exit of Vietnamese Citizens in 2019 (amended by Clause 7 Article 1 of the Law on Entry and Exit of Vietnamese Citizens and Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam in 2023) stipulating cases of revocation of passports in Vietnam as follows:

Cases of revocation and cancellation of passports

1. Cancel an unexpired but lost passport or cancel a passport in case it is not received by the applicant after 12 months from the appointment date without a written explanation being sent to the competent authority.

2. Revoke and cancel passports of persons subject to renunciation, denaturalization or annulled decision on naturalization of Vietnamese nationality.

3. Revoke and cancel valid diplomatic passports and service passports if holders are no longer eligible for use thereof.

4. Revoke and cancel passports issued to persons specified in Clause 1 Article 21 of this Law.

As regulations above, cases of revocation of passports in Vietnam are:

- Persons whose nationality is revoked, whose Vietnamese nationality is revoked, or whose decision for naturalization is revoked;

- Persons who have not yet complied with decisions on sanctioning administrative violations for the following violations:

+ Deliberately providing false information to obtain, renew, restore or report loss of immigration papers.

+ Forging, using fake immigration papers to exit, enter or travel, reside abroad.

+ Giving, giving, buying, selling, borrowing, lending, renting, leasing, pledging, accepting pledge of immigration papers; destroying, erasing and correcting immigration documents.

Using immigration documents contrary to law, adversely affecting the reputation or causing damage to the interests of the State.

+ Taking advantage of exit or entry to infringe upon national security, social order and safety of Vietnam, the lawful rights and interests of agencies or organizations or the life, health, or legitimate interests of individuals.

+ Illegal entry and exit; organizing, brokering, helping, harboring, concealing, facilitating other people's illegal exit or entry; cross national borders without following prescribed procedures.

+ Obstructing or resisting law enforcement officials in the issuance of entry and exit documents or immigration control.

What is the validity period of the regular passports issued to persons from 14 years of age in Vietnam?

Pursuant to Article 7 of the Law on Entry and Exit of Vietnamese Citizens in 2019 stipulating validity of entry and exit documents as follows:

Validity of entry and exit documents

1. Diplomatic passports and service passports shall be effective from 1 to 5 years; can be extended no more than 3 years per instance.

2. Validity of regular passports is as follows:

a) Regular passports issued to persons from 14 years of age shall be effective for 10 years and shall not be extended;

b) Regular passports issued to persons under 14 years of age shall be effective for 05 years and shall not be extended;

c) Regular passports issued by shortened procedures shall be effective for no more than 12 months and shall not be extended.

3. Laissez-passers shall be effective for no more than 12 months and shall not be extended.

As regulations above, regular passports issued to persons from 14 years of age shall be effective for 10 years and shall not be extended.

Note: Circular 31/2023/TT-BCA and the Law on Entry and Exit of Vietnamese Citizens and Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam in 2023 take effect from 15/08/2023.
