Conditions to Become a Guardian?
According to the current regulations of our country, both individuals and legal entities can become guardians.
The conditions for individuals and legal entities to become guardians are stipulated in Article 49 and Article 50 of the Civil Code 2015 with the following content:
- Individuals who meet the following conditions can become guardians:
+ Have full civil act capacity.
+ Have good moral character and the necessary conditions to exercise the rights and obligations of a guardian.
+ Are not persons currently under criminal investigation or persons who have been convicted but have not yet had their convictions expunged for any of the offenses intentionally infringing on the life, health, honor, dignity, property of others.
+ Are not persons declared by the Court to have restricted rights concerning their minor children.
- Legal entities that meet the following conditions can become guardians:
+ Have civil legal capacity suitable for guardianship.
+ Have the necessary conditions to exercise the rights and obligations of a guardian.
