Is it permissible to sell fertilizers without receiving professional training on fertilizers?
If not trained in fertilizer expertise, can one sell fertilizers?
Based on Article 42 of the 2018 Crop Production Law regulating the conditions for selling fertilizers as follows:
- Organizations and individuals selling fertilizers must have a Certificate of eligibility for fertilizer trading; if selling fertilizers produced by themselves, they do not need a Certificate of eligibility for fertilizer trading.
2. Conditions for granting a Certificate of eligibility for fertilizer trading include:
a) Having a legal and clear transaction location;
b) Having complete documents tracing the origin of the fertilizers as prescribed;
c) The person directly involved in selling fertilizers must be trained and educated in fertilizer expertise under the guidance of the Ministry of Agriculture and Rural Development, except for those with an intermediate level or higher in one of the fields: crop production, plant protection, agricultural chemistry, soil science, agronomy, chemistry, biology.
- The Government of Vietnam stipulates in detail the conditions, dossiers, procedures, duration, authority for granting, re-granting, and revoking the Certificate of eligibility for fertilizer trading.
Thus, to be able to sell fertilizers, one must have a Certificate of eligibility for fertilizer trading. If selling fertilizers produced by oneself, no certificate is required. One of the conditions for being granted this certificate is to be trained and educated in fertilizer expertise according to the guidelines or having an intermediate level or higher in one of the fields: crop production, plant protection, agricultural chemistry, soil science, agronomy, chemistry, biology. If you have not been trained in fertilizer expertise but possess the required educational qualifications and meet other conditions, you can still apply for the Certificate of eligibility for fertilizer trading to engage in the business.
What does the dossier for the Certificate of eligibility for fertilizer trading include?
According to Article 15 of Decree 84/2019/ND-CP stipulating the dossier for granting the Certificate of eligibility for fertilizer trading as follows:
Application for the Certificate of eligibility for fertilizer trading, according to Form No. 08 in Appendix I issued with this Decree.
Copy of the document certifying that the person directly involved in selling fertilizers has been trained and educated in fertilizer expertise or holds an intermediate or higher degree as prescribed at point c, clause 2, Article 42 of the Crop Production Law.
