- employees who meet the conditions for the period of paying social insurance premiums as prescribed by law on social insurance are entitled to a pension when they reach retirement age.
- The retirement age of employees in normal working conditions is adjusted according to a roadmap until reaching 62 years of age for male employees by 2028 and 60 years of age for female employees by 2035.
From 2021, the retirement age of employees in normal working conditions shall be 60 years 03 months for male employees and 55 years 04 months for female employees; thereafter, every year, it will increase by 03 months for male employees and 04 months for female employees.

Pursuant to Clause 2, Article 36 of the Labor Code 2024 regulating the right to unilaterally terminate employment contracts by employees:
Article 35. Right to unilaterally terminate employment contracts by employees

. employees have the right to unilaterally terminate employment contracts without prior notice in the following cases:
a) Not being arranged according to the agreed work or workplace, or not being guaranteed the agreed working conditions, except for the cases prescribed in Article 29 of this Code;
b) Not being paid in full or not being paid on time, except for the cases prescribed in Clause 4, Article 97 of this Code;
c) Being maltreated, beaten or having abusive language, acts of humiliation, acts affecting health, dignity, honor; being forced to work;
d) Being sexually harassed at the workplace;
dd) Female employees having to quit their jobs due to pregnancy as prescribed in Clause 1, Article 138 of this Code;
e) Being eligible for retirement age as prescribed in Article 169 of this Code, except where otherwise agreed by the parties;
g) The employer provides untruthful information as prescribed in Clause 1, Article 16 of this Code, affecting the performance of the employment contract.
According to the above regulations, employees who are eligible for retirement age have the right to unilaterally terminate their employment contracts without prior notice, except where otherwise agreed by the parties.
What are regulations on late retirement in normal working conditions in Vietnam?
Pursuant to Article 6 of Decree 135/2020/ND-CP regulating retirement at an age higher than the retirement age in normal working conditions of employees as prescribed in Clause 4, Article 169 of the Labor Code 2019, the specific regulations are as follows:
- employees can retire at an age higher than the retirement age when reaching an agreement with their employer to continue working after the retirement age under normal working conditions.
- The termination of employment contracts and the settlement of social insurance benefits for employees retiring at an age higher than the retirement age under normal working conditions shall comply with the provisions of Section 3, Chapter 3 of the Labor Code 2019 and regulations of the law on social insurance.
