- Motto: "Independence - Freedom - Happiness" in lowercase, regular, bold font; centered below the national emblem; the first letter of each phrase is capitalized, short dashes between phrases, with word spacing; a solid line is placed underneath, the length of which matches the length of the text.

- Finally, the title "JOB RESIGNATION APPLICATION" is written in uppercase, large font size.

  1. The middle section of the resignation application is the main content of the application. When writing the content of the resignation application, you need to provide all the details in the following order:

(1) Place/person receiving the application: indicate departments/persons directly involved in resolving the resignation application.

Example: To: The Board of Directors of Thai Bao Food Co., Ltd./Human Resources Department/Marketing Manager.

Based on Clause 1, Article 35 of the Labor Code 2019 on the employee's right to unilaterally terminate a labor contract:

Article 35. The employee's right to unilaterally terminate a labor contract

  1. The employee has the right to unilaterally terminate a labor contract but must give prior notice to the employer as follows:

a) At least 45 days if working under an indefinite-term labor contract;

b) At least 30 days if working under a fixed-term labor contract with a duration from 12 months to 36 months;

c) At least 03 working days if working under a fixed-term labor contract with a duration of under 12 months;

d) For a number of specific sectors, professions, and jobs, the notice period shall be in accordance with the Government of Vietnam's regulations.

When is a labor contract terminated in Vietnam?

Based on Article 34 of the Labor Code 2019 on the cases for termination of a labor contract:

- The labor contract term expires, except for cases where the contract must be renewed.

- The work stated in the labor contract has been completed.

- Both parties agree to terminate the labor contract.

- The employee is convicted of imprisonment without probation or is not eligible for release under the law, sentenced to death or prohibited from performing the work specified in the labor contract according to a legally effective court judgment or decision.

- The employee is a foreigner working in Vietnam and is deported according to a legally effective court judgment or decision or a decision by a competent state authority.

- The employee dies; is declared by a court to have lost legal capacity, is missing, or has died.

- The employer is an individual who dies; is declared by a court to have lost legal capacity, is missing, or has died.

- The employer, not an individual, ceases operations, or a competent business registration authority of the provincial People's Committee issues a notice that there is no legal representative, person authorized to perform the rights and obligations of the legal representative.

- The employee is subjected to disciplinary dismissal.

- The employee unilaterally terminates the labor contract according to regulations;

- The employer unilaterally terminates the labor contract according to regulations;

- The employer allows the employee to quit according to regulations;

- The work permit expires for a foreign employee working in Vietnam as regulated;

- In cases where the probationary content agreement in the labor contract fails to meet requirements or one party cancels the probation agreement.
