What is the 2024 Tet holiday schedule of all Vietnamese citizens?

[1] For New Year 2024

Pursuant to Article 13 of the Law on Public Employees 2010, Article 13 of the Law on Cadres and Civil Servants 2008, for cadres, civil servants and public employees, their holiday and New Year holidays will comply with the provisions of labor law.

According to Article 112 of the 2019 Labor Code, regulations on Public holidays are as follows:

Public holidays

1. Employees shall be entitled to fully paid days off on the following public holidays:

a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);

b) Lunar New Year Holidays: 05 days;

c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);

d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);

dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);

e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).

2. Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of this Article.

3. The Prime Minister shall decide the specific public holidays mentioned in Point b and Point dd Clause 1 of this Article on an annual basis.

At the same time, Article 111 of the 2019 Labor Code stipulates weekly breaks as follows:

3. In case a public holiday falls on an employee’s weekly break coincide with a public holiday as prescribed in Clause 1 Article 112 of this Labor Code, he/she will have compensatory time-off on the next working days.

According to this Article, employees are entitled to one day off work with pay on New Year's Eve.

New Year's Day, January 1, 2024, will fall on Monday, so employees will have time off from work on this day.

- The 2024 New Year holiday schedule for employees is as follows:

For employees working on Saturdays: two consecutive days off: Sunday (December 31, 2023) and Monday (January 1, 2024).

For employees who do not work on Saturdays: 03 consecutive days off are Saturday (December 30, 2023), Sunday (December 31, 2023) and Monday (January 1, 2024).

However, due to the nature of the job, there are cases where employees still have to go to work on the New Year holiday. In this case, the employee is entitled to salary in Article 98 of the 2019 Labor Code.

- The 2024 New Year holiday schedule for officials, civil servants and public employees is as follows:

Normally, officials, civil servants, and public employees will not work on Saturdays, so they will have 3 consecutive days off: December 30, 2023, December 31, 2023, and January 1, 2024 (ie from Saturday through Monday)

- New Year 2024 holiday schedule for pupils and students:

The 2024 New Year holiday schedule for students is completely based on the regulations of each educational institution. However, teachers and lecturers are officials and workers, so they will take the New Year off according to the provisions of labor law.

Therefore, the number of days off for New Year 2024 for students is also the number of days off according to the New Year holiday schedule for teachers and lecturers.

Note : In case of working on Saturday, there will be 02 consecutive days off: Sunday (December 31, 2023) and Monday (January 1, 2024).

[2] For Lunar New Year 2024 (Tet 2024):

According to Notice 5015/TB-LDTBXH of 2023 on the Lunar New Year holiday and National Day holiday in 2024 for officials, civil servants, public employees and workers.

According to this regulation, the 2024 Lunar New Year holiday schedule for civil servants and employees is as follows:

- For civil servants and employees, they will have 07 days off for the 2024 Lunar New Year.

Specifically, from Thursday, February 8, 2024 (on the 29th of the December month in the year of the Cat) to the end of Wednesday, February 14, 2024 (on the 5th of the first month of the year of the Dragon).

The 2024 Lunar New Year holiday schedule includes 05 days off for Lunar New Year and 02 days off to compensate for weekly holidays according to the 2019 Labor Code.

- For other employees, the employer decides to choose the Lunar New Year and National Day holiday plan in 2024 as follows:

- For the Lunar New Year holiday: choose 01 last day of the year Quy Cat and 04 first days of the year Giap Thin or 02 last days of the year Quy Mao and 03 first days of the year Giap Thin or 03 last days of the year Quy Mao and 02 first days of the year Giap Thin.

- For National Day holiday: Monday, September 2, 2024, Gregorian calendar and choose 1 of 2 days: Sunday, September 1, 2024 or Tuesday, September 3, 2024.

- Inform the Lunar New Year holiday plan to employees at least 30 days before implementation.

- For pupils and students: The 2024 Tet holiday schedule will be announced by the School and the People's Committee in that locality to decide the 2024 Lunar New Year holiday. However, it will not be less than 07 days because normally Students will still have a higher Tet holiday schedule than officials, civil servants, public employees and employees.

Can employees take unpaid leave to celebrate Tet in 2024 in Vietnam?

Pursuant to Clause 3, Article 115 of the 2019 Labor Code, regulations on personal leave, unpaid leave are as follows:

Personal leave, unpaid leave

1. An employee is entitled to take a fully paid personal leave in the following circumstances, as long as it is notified to the employer in advance:

a) Marriage: 03 days;

b) Marriage of his/her biological child or adopted child: 01 day;

c) Death of his/her biological or adoptive parent; death of his/her spouse’s biological or adoptive parent; death of spouse, biological or adopted child: 03 days.

2. An employee is entitled to take 01 day of unpaid leave and must inform the employer in the case of the death of his/her grandparent or biological sibling; marriage of his/her parent or natural sibling.

3. The employee may negotiate with his/her employer on taking unpaid leave other than the leave stipulated in Clause 1 and Clause 2 of this Article.

According to this Article, employees can agree with the employer on unpaid leave in Vietnam.

If the employer agrees, the employee will be given unpaid leave corresponding to the number of days agreed upon by both parties in Vietnam.

What is proposed gift level on occasion of Lunar New Year of Giap Thin 2024 for people with meritorious services to the revolution in Vietnam?

In Report 1255/TTr-TTg dated November 29, 2023 on submitting to the President to give gifts to people with meritorious services to the revolution on the occasion of the Lunar New Year Giap Thin in 2024. According to this regulation, the expected level of gifts on the occasion of Lunar New Year Giap Thin 2024 will be:

For gift amount of 600,000 VND:

- People who contributed to the revolution include:

+ People who participated in revolutionary activities before January 1, 1945 are receiving preferential monthly benefits;

+ People who participated in revolutionary activities from January 1, 1945 to the August uprising in 1945 are receiving preferential monthly benefits;

+ Vietnamese heroic mothers are enjoying preferential monthly benefits;

+ Heroes of the People's Armed Forces and Labor Heroes during the resistance period are receiving preferential monthly benefits;

+ Wounded soldiers, policy beneficiaries such as war invalids, class B war invalids, sick soldiers with a physical injury rate of 81% or more are receiving preferential monthly benefits;

+ Resistance activists infected with toxic chemicals with a bodily injury rate of 81% or more are receiving preferential monthly benefits; People who have contributed to helping the revolution are receiving a monthly maintenance allowance.

- Relatives of martyrs are receiving monthly survivor benefits; Relatives of two or more martyrs are receiving monthly death benefits.

For a gift of 300,000 VND:

- People with meritorious services to the revolution:

+ War invalids, policy beneficiaries such as war invalids, class B war invalids, sick soldiers with a physical injury rate of 80% or less are receiving preferential monthly benefits. War invalids are receiving disability benefits.

+ Resistance activists infected with toxic chemicals with a bodily injury rate of 80% or less are receiving preferential monthly benefits.

+ Revolutionary or resistance activists who are imprisoned or exiled by the enemy are receiving preferential monthly benefits.

+ People who have contributed to helping the revolution are receiving preferential monthly benefits.

- Representative of martyrs' relatives;

- People who worship martyrs (in cases where martyrs have no relatives).

Note: The above gift levels are only suggestions. Currently, there is no official document on giving gifts to people with contributions to the revolution on the occasion of Lunar New Year 2024 in Vietnam.
