Pursuant to Article 112 of the Labor Code 2019 regarding holidays:
Article 112. Holidays
- Employees shall be entitled to a full paid day off on the following holidays:
a) New Year's Day: 1 day (January 1 of the solar calendar);
b) Lunar New Year: 5 days;
c) Victory Day: 1 day (April 30 of the solar calendar);
d) International Labor Day: 1 day (May 1 of the solar calendar);
e) National Day: 2 days (September 2 of the solar calendar and 1 contiguous day before or after);
f) Hung Kings Commemoration Day: 1 day (March 10 of the lunar calendar).
- Foreign employees working in Vietnam are entitled to additional 1 traditional Vietnamese Tet holiday and 1 national day of their country besides the holidays prescribed in Clause 1 of this Article.
- Annually, based on actual conditions, the Prime Minister of Vietnam decides the specific leave days prescribed at points b and e of Clause 1 of this Article.
According to the regulations, employees are entitled to a full paid day off on the following holidays:
- New Year's Day
- Lunar New Year
- Victory Day
- International Labor Day
- National Day
- Hung Kings Commemoration Day
Moreover, foreign employees working in Vietnam are entitled to an additional day for their national traditional Tet holiday and a national day of their country.

How many annual leave days are available for employees who have not worked for 12 months in Vietnam?
Pursuant to Article 113 of the Labor Code 2019 regarding annual leave:
Article 113. Annual leave
- Employees who have worked for a full 12 months for an employer shall be entitled to annual leave, enjoying full salary according to their labor contract as follows:
a) 12 working days for employees working under normal conditions;
b) 14 working days for minor employees, employees with disabilities, employees working in heavy, hazardous, or dangerous industries;
c) 16 working days for employees in special heavy, hazardous, or dangerous industries.
- Employees working for less than 12 months for an employer shall be entitled to annual leave in proportion to the number of months worked.
- In case of job termination or job loss without having taken or fully taken annual leave days, the employer shall pay an allowance for the untaken leave days.
- Employers are responsible for arranging annual leave schedules after consulting employees and must inform employees in advance. Employees may agree with their employer to take annual leave in separate instances or accumulatively once every 3 years maximum.
- If annual leave occurs not at salary payment time, employees shall receive an advance salary payment as prescribed in Clause 3, Article 101 of this Code.
- If annual leave involves traveling via road, railway, or waterway where the total travel days exceed 2 days, from the third day onward, additional travel days shall be granted beyond annual leave and counted only for 1 leave instance in the year.
- The Government of Vietnam shall detail this Article.
According to the above regulations, employees who have not worked for 12 months for an employer shall be entitled to annual leave in proportion to the number of months worked.
