Standards and Conditions for Promotion to Grade 1 of Administrative Public Employees

Question: What are the standards and conditions for considering a promotion to Grade 1 of administrative public employees? How many principles are there currently for managing public employees?

Is there Circular 05 on standards and conditions for public employee promotion in administrative roles?

On June 27, 2024, the Minister of Home Affairs promulgated Circular 05/2024/TT-BNV stipulating the standards and conditions for promotion to grade 2 and grade 1 for public employees in administrative, clerical roles, and archive officers; salary grading for those recruited into public employee positions.

Circular 05/2024/TT-BNV applies to the following subjects:

- Public employees in job positions within the departments of administration, synthesis, office management, personnel organization, planning, finance, and other job positions that do not hold professional titles and do not engage in professional activities within public service providers (collectively referred to as administrative public employees) who are eligible for promotion to grade 2 (from expert to senior expert) and grade 1 (from senior expert to principal expert).

- Clerical public employees in job positions within the departments of clerical work, and administration of public service units (collectively referred to as clerical public employees) who are eligible for promotion to grade 2 (from clerical officer to senior clerical officer).

- Archive public employees in public service units who are eligible for promotion to grade 2 (from archive officer to senior archive officer).

Based on Clause 2, Article 3 of Circular 05/2024/TT-BNV, administrative public employees seeking promotion to grade 1 must meet the following standards and conditions:

- Rated at least "completed tasks successfully" in the work year immediately preceding the year of consideration for professional title promotion; have good political qualities and professional ethics; not under disciplinary action; not in the period of implementing regulations related to discipline according to the rules of the Communist Party and the law.

- Have the capability, professional qualifications, and expertise to undertake a higher-level professional title next to the current one in the same professional field.

- Meet the requirements for diplomas, certificates, and other requirements of the professional title standards under consideration for promotion.

In the case where at the time of consideration for promotion the Ministry managing the professional title of the public employee sector has not issued regulations on content, programs, forms, and training time as required, compliance with training certificate requirements for professional titles will not be necessary. The public employee considered for promotion will be deemed to meet the standards and conditions of the promoted grade.

- Meet the minimum working time requirement for holding the immediate lower-grade professional title according to the standards of the professional title under consideration for promotion, except in cases where there is no immediate lower grade at the time of consideration for promotion.

In cases where public employees, before being recruited, were employed and paid compulsory social insurance contributions in a professional position (excluding probationary periods according to the law), they may have this working time considered as equivalent to the current professional title if this period was relevant to professional requirements (uninterrupted periods are cumulative if no one-time social insurance benefits were received).

For equivalent time calculations, the immediate lower-grade professional title must have been held for at least 12 months by the deadline for submitting the application for promotion consideration.

- Job positions within public service providers must be constructed and approved according to the law and feature positions for the considered professional title.

- Be authorized by a competent level to attend the promotion consideration.

- Must have held the senior expert and equivalent professional title for at least 6 years. If there is an equivalent time with the senior expert title, at least 1 year (full 12 months) must be of senior expert title holding by the deadline for application submission for promotion consideration (in case of non-consecutive time holding, it is cumulative).

- During the time of holding the senior expert and equivalent title, the public employee must have one of the following scientific tasks confirmed by a competent authority in writing (with accompanying documents):

+ Leading the formulation of regulations, procedures, and technical processes in the sector or field where they work, which have been issued and confirmed by the head of the agency or unit.

+ Leading scientific and technological tasks at least at the grassroots level that have been evaluated and approved.

+ Participating in the formulation of proposals, regulatory documents that have been issued and confirmed by the head of the agency or unit responsible.

- During the time of holding the senior expert and equivalent title, the public employee must have one of the following achievements:

+ Recognized for contributions in professional tasks with a commendation from the Prime Minister of the Government of Vietnam or obtaining titles such as emulation fighters at the Ministry, sector, or provincial levels.

+ Rated for at least 3 years with outstanding performance.

When does Circular 05/2024/TT-BNV take effect?

According to Clause 1, Article 6 of Circular 05/2024/TT-BNV:

Effective date

  1. This Circular will take effect from August 15, 2024.

  2. In case the documents referenced in this Circular are amended, supplemented, or replaced, the new documents will apply; and in case they expire, relevant provisions in this Circular will also cease to be effective.

  3. Annul Article 9 of Circular No. 07/2022/TT-BNV dated August 31, 2022, by the Minister of Home Affairs regarding professional titles, codes, career title standards, promotion exams, or consideration, appointment, and salary grading of archive professional public employees.

  4. Annul point b, clause 3, Article 16 of Circular No. 02/2021/TT-BNV dated June 11, 2021, by the Minister of Home Affairs regarding professional title codes, standards, and salary grading for administrative and clerical officer sectors concerning the application of regulation on topics and proposals for promotion to principal expert or senior expert.

Thus, Circular 05/2024/TT-BNV will officially take effect from August 15, 2024.

How many principles currently exist for managing public employees?

Article 6 of the Public Employees Law 2010 specifies 4 principles of managing public employees. According to it:

- Ensure the leadership of the Communist Party of Vietnam and the unified management of the State.

- Ensure the autonomy and responsibility of the heads of public service providers.

- Recruitment, utilization, management, and evaluation of public employees are based on professional title standards, job positions, and labor contracts.

- Implement gender equality and preferential policies of the State for talented individuals, ethnic minorities, revolution contributors, public employees working in mountainous, border, island areas, remote, ethnic minority regions, and areas with particularly difficult socio-economic conditions, and other preferential state policies for public employees.
