Is the probationary period counted towards annual leave according to the law in Vietnam?

When an employee signs an official Labor Contract, is the probation period counted in the working time at the company for the calculation of leave days according to the law in Vietnam?

According to Article 65 of Decree 145/2020/ND-CP regulating the time considered as working time to calculate annual leave days for employees. To be specific:

  1. The time spent on vocational training and apprenticeship as stipulated in Article 61 of the Labor Code if, after the vocational training and apprenticeship period, the employee works for the employer.

  2. The probation period if the employee continues to work for the employer after the probation period ends.

Based on the above regulation, if the employee continues to work (signs an official contract) for the employer after the probation period, the probation period is considered as working time to calculate the annual leave days for the employee in Vietnam.
