Is it possible to withdraw an already submitted unemployment benefit application?
Article 7 Circular 28/2015/TT-BLDTBXH stipulates cases where employees do not need to receive unemployment benefits as follows:
Within 15 working days from the date of submitting the application for unemployment benefits, if the employee does not need to receive unemployment benefits, the employee must directly submit the request for not receiving unemployment benefits according to Form No. 08 issued together with this Circular to the employment service center where the employee submitted the application for unemployment benefits.
The employment service center is responsible for returning the application for unemployment benefits to the employee on the result return date according to the appointment slip.
Therefore, you submitted the application on December 10, 2020 - today is December 16, which is still within the 15-day period from the submission date.
=> If you do not want to receive unemployment benefits anymore, you must directly submit the request for not receiving unemployment benefits to the employment service center where you submitted the application. The employment service center will be responsible for returning the application for unemployment benefits to you.
