Is it legal to pay employees for unused annual leave while they are still working?
Section 3, Article 113 of the 2019 Labor Code stipulates the payment of annual leave as follows:
In case of resignation or job loss without taking annual leave or without using up all the annual leave days, the employer is required to pay wages for the unused days.
According to this regulation, it can be understood that the payment for annual leave is to be made when the employee terminates employment or loses their job without having taken annual leave or without having used up all the annual leave days.
Therefore, it is not in compliance with legal regulations for the company to pay for annual leave while the employee is still working.
