How long can a member fail to pay union dues before facing disciplinary action in the form of a warning in Vietnam?

Based on Article 25 of the Regulations on Disciplinary Action within Trade Unions, issued in conjunction with Decision 5130/QD-TLD 2022, on the content of violations and forms of disciplinary action against union members:

Article 25. Content of violations and forms of disciplinary action against union members

  1. Union members who commit any of the following violations shall be subject to disciplinary action in the form of a reprimand:

a) Not complying with and failing to implement the Charter of the Vietnam General Confederation of Labor, resolutions, decisions, regulations, plans, work programs... of trade unions at various levels, causing minor consequences.

b) Failing to attend 50% or more of the trade union meetings in a year.

c) Not paying union fees continuously for 6 months without a legitimate reason.

  1. Union members who commit any of the following violations shall be subject to disciplinary action in the form of a warning:

a) Previously subjected to disciplinary action under Point a, Clause 1 of this Article and repeating the offense, or committing a first-time violation causing serious consequences.

b) Failing to attend 70% or more of the trade union meetings in a year.

c) Not paying union fees continuously for 9 months without a legitimate reason.

  1. Union members who commit any of the following violations shall be subject to disciplinary action in the form of expulsion:

a) Previously subjected to disciplinary action under Point a, Clause 2 of this Article and repeating the offense, or committing a first-time violation causing very serious consequences.

b) Failing to attend 90% or more of the trade union meetings in a year.

c) Not paying union fees continuously for 12 months without a legitimate reason.

According to the above regulations, union members not paying union fees continuously for 9 months without a legitimate reason will be disciplined in the form of a warning.

How many levels are there in the Vietnam General Confederation of Labor?

Based on Article 8 of the Trade Union Law 2024 on the organizational system of the Vietnam General Confederation of Labor:

Article 8. Organizational system of the Vietnam General Confederation of Labor

  1. The Vietnam General Confederation of Labor is a unified organization consisting of four levels as follows:

a) The central level is the Vietnam General Confederation of Labor;

b) The provincial, central sectoral, and equivalent trade unions include labor federations of provinces and central-affiliated cities (hereinafter referred to as provincial labor federations); central sector unions; economic group unions, general corporation unions under the Vietnam General Confederation of Labor;

c) The immediate superior grassroots-level trade unions include district labor federations, urban districts, district-level towns, cities under provincial authority, cities under centrally-governed cities (hereinafter referred to as district labor federations); local sector unions; economic group unions, general corporation unions not specified under point b of this clause; trade unions in industrial zones, export processing zones, economic zones, high-tech zones; other immediate superior grassroots-level trade unions as prescribed by the Charter of the Vietnam General Confederation of Labor;

d) The grassroots-level trade unions include grassroots unions and grassroots labor associations.

  1. The Vietnam General Confederation of Labor decides on the establishment and determines the level of the trade union for the administrative-economic special unit based on a decision by the National Assembly to establish such units.
  1. The model of the trade union organization is constructed in an open, flexible manner, suitable to the legitimate needs and aspirations of union members, laborers, practical requirements, and legal provisions. The Vietnam General Confederation of Labor is responsible for guiding the implementation of the content specified in this clause.

What are the contents of international cooperation concerning labor unions in Vietnam?

According to Article 9 of the Trade Union Law 2024, international cooperation in trade unions includes the following contents:

- Information dissemination and promotion of the country's foreign policies, socio-economic development achievements

- Training and capacity building for trade union staff

- Sharing experiences in trade union activities, international workers' movements; conducting activities of solidarity, international support

- Establishing cooperation, negotiating, signing, and implementing bilateral and multilateral commitments and agreements; representing workers at the national level in participation in international forums; engaging in activities, joining or withdrawing from international trade union organizations

- Mobilizing, coordinating, approving, receiving, and managing assistance, sponsorship, and technical support from international partners for the Trade Union as per legal regulations

- Receiving and awarding forms of commendation

- Conducting other public diplomacy activities consistent with the functions and tasks of the Vietnam General Confederation of Labor
