9-month Labor Contract: 30-day Prior Notice Required for Leave

May I ask, my labor contract is only for 9 months, and I have been working for more than 6 months now. If I want to resign now, do I have to give 30 days' notice? I heard that for a fixed-term contract, a 30-day notice is required.

Section 1, Article 35 of the Labor Code 2019 provides:

- Employees have the right to unilaterally terminate the labor contract but must give prior notice to the employer as follows:

+ At least 45 days if working under an indefinite-term labor contract;

+ At least 30 days if working under a definite-term labor contract with a duration from 12 months to 36 months;

+ At least 3 working days if working under a definite-term labor contract with a duration of less than 12 months;

...

Thus, although it is the same type of definite-term labor contract, the notice period varies depending on the duration of the contract. For your case with a 9-month labor contract, only a minimum of 3 working days' notice is needed to resign.
