What is the scope of the navigation channel protection corridor?
Article 33 of Decree 08/2021/ND-CP stipulates the scope of the waterway protection corridor as follows:
The scope of the waterway protection corridor is determined from the edge of the waterway outward on each side. For waterways already included in approved planning, the determination is based on the technical level of the plan. Specifically:
- Scope of the waterway protection corridor in cases where the waterway is not adjacent to the shore:
+ For inland waterways on lakes, bays, river mouths to the sea, coastal areas, and special-grade waterways: from 20 m to 25 m;
+ For inland waterways of grades I and II: from 15 m to 20 m;
+ For inland waterways of grades III and IV: from 10 m to 15 m;
+ For inland waterways of grades V and VI: 10 m.
- Scope of the waterway protection corridor in cases where the waterway is adjacent to the shore:
The corridor is measured from the natural edge of the shore inward to the shore by at least 5 m; in cases where the waterway passes through city areas, district-level towns, or commune-level towns, the scope of the waterway protection corridor is determined by the red line boundary according to approved planning by competent authorities.
- Based on the characteristics of each area, the Vietnam Inland Waterways Administration, and the Department of Transport shall lead and cooperate with the Department of Natural Resources and Environment to specifically determine the natural edge of the shore to serve the protection of inland waterway infrastructure constructions.
- In cases where the scope of the waterway protection corridor overlaps with the safety corridor of road bridges or railway bridges, the scope of the waterway protection corridor is measured from the edge of the waterway to the natural edge of the shore and implemented according to the regulations of the law on the protection of road bridge safety corridors and railway bridge safety corridors.
- In cases where the scope of the waterway protection corridor overlaps with the maritime waterway protection corridor, implementation shall follow the regulations of the law on the protection of maritime waterway corridors.
- In cases where the scope of the waterway protection corridor overlaps with the protection scope of structures for disaster prevention, dike protection, and irrigation works, implementation shall follow the regulations of the law on disaster prevention, dike protection, and the law on the exploitation and protection of irrigation works.
- In cases where the scope of the waterway protection corridor overlaps with the safety corridor for water source protection, implementation shall follow the regulations of the law on the protection of waterway protection corridors.
- When formulating new construction investment projects or upgrading and expanding inland waterways, the project investor must base on the inland waterway infrastructure planning to clearly determine the technical level of the inland waterway, simultaneously determine the scope of the waterway protection corridor, and set up boundary markers after completing the project.
