Pursuant to Clauses 2.a and 9.a, Article 16 of the Decree 100/2019/ND-CP (amended by Clause 9 Article 2 of the Decree 123/2021/ND-CP) stipulating the fines imposed on operators of cars for failure to equip fire extinguisher in Vietnam:

Penalties imposed upon by operators of motor vehicles (including trailers or semi-trailers being towed) and the like violating regulations on roadworthiness of vehicles

1. A fine ranging from VND 100,000 to VND 200,000 shall be imposed for operating a vehicle without a windshield or without an intact and functional one (for vehicles having a windshield).

2. A fine ranging from VND 300,000 to VND 400,000 shall be imposed for any of the following offences:

a) Operating a vehicle without adequate and functional headlamps, plate lamp, brake lamps, turn signals, windshield wipers, rear-view mirrors, safety belts, emergency equipment, fire fighting equipment, pressure meter, and speedometer (for vehicles required to have them), except for the offences specified in point m clause 3 Article 23 and point q clause 4 Article 28 of this Decree;

9. Apart from the penalties, the violator is compelled to:

a) Install equipment or replace equipment that meets technical safety standards or restore technical attributes of the equipment as prescribed if the offence specified in clause 1; clause 2; point b, point c clause 3; point c, point d clause 4; point b clause 5; point d clause 6 of this Article is committed;

b) Install equipment or restore technical attributes of the equipment or remove additional equipment installed against regulations if any of the offences specified in point a, point d clause 3 of this Article is committed.

As regulated above, the fines imposed on operators of cars for failure to equip fire extinguisher in Vietnam are ranging from VND 300,000 to VND 400,000.

In adddition, the operators violating regulations on roadworthiness of vehicles are compelled to install equipment or replace equipment that meets technical safety standards or restore technical attributes of the equipment as prescribed by law.

Small fire extinguisher

A fire extinguisher with small dimensions that is intended for one-time use, with a maximum capacity of firefighting agent not exceeding 950 ml or a mass of firefighting agent not exceeding 950 g, and can be activated by a single finger. The agents contained in the extinguisher are discharged when the control valve is opened.

NOTE: A small fire extinguisher is designed to be discarded after use and is not refillable.

What additional information shall be labeled on a small fire extinguisher according to in Vietnam?

Based on Subsection 5.2, Section 5 of the National Standard TCVN 13260:2021, the small fire extinguisher must be labeled with the following additional information:

- Name and address of the manufacturer or supplier.

- Instructions for pressure testing, regular maintenance, and handling of the small fire extinguisher if the pressure at 20°C drops below the pressure in the green region (nominal working pressure).

- Date of manufacture and expiration date (not exceeding 5 years from the date of manufacture).

- Number and year of this standard, which is TCVN 13260:2020.

- Classification of the small fire extinguisher and firefighting capacity.

- Nominal mass and type of firefighting agent (e.g., "0.8 kg powder fire extinguisher"); mass of the small fire extinguisher shell.

- Instructions for proper disposal after expiration or partial discharge of the small fire extinguisher; in the case of a small fire extinguisher using halon as the firefighting agent, the instructions will include the phrase "Return to the manufacturer for halon recovery."

- "Not refillable" indication.

- Instruction "Pressurized container: protect from sunlight and other heat sources and do not exceed 60°C. Do not drill or burn, even after use."

- The letter height of the labeling in the instructions and indications should not be smaller than 1.2 mm and should be larger than the height of the other letters on the label.

Note:

- The main information must be labeled on a separate part of the small fire extinguisher body from the additional information.

- It is recommended that small fire extinguishers have a predominantly red color and a colored area covering up to 10% of the surface area on the small fire extinguisher shell to identify the firefighting agent.

- The labeling method must be clear and legible throughout the expected period of use/expiration of the small fire extinguisher.

- On the small fire extinguisher shell or on a separate leaflet accompanying the small fire extinguisher, installation and usage instructions for the small fire extinguisher should be provided.
