Traffic Police Request to Stop Vehicle for Inspection on the Highway: Is It Legal?
According to Point c, Clause 2, Article 16 of Circular 65/2020/TT-BCA regulating the stopping of traffic vehicles for inspection as follows:
When stopping and inspecting traffic vehicles on the highway, the requirements specified at points a and b of this Clause and the following requirements must be ensured:
- When inspecting at one point, traffic vehicles may only be stopped for inspection and handling of violations at the following locations: Toll station areas, starting points, and ending points of the highway;
- When patrolling and conducting mobile inspections, traffic vehicles may only be stopped in the emergency stopping lanes to inspect and handle violations in the following cases: Detection of serious traffic order and safety violations, a risk of immediate traffic safety loss; coordinating in the fight against crime; receiving reports and accusations about law violations of people and vehicles circulating on the highway; detection of vehicles stopping and parking non-conformably on the highway. Upon resolving the incident, cones, barriers, and signs must be cleaned up, and moved away immediately.
Based on the aforementioned regulations, the traffic police are allowed to stop moving vehicles on the highway for inspection but must ensure the stopping positions are toll station areas, starting points, and ending points of the highway.
If the traffic police stop your vehicle at the 3 aforementioned positions, it ensures compliance with the legal regulations on stopping positions on the highway.
