Proposal: What is the minimum age of a driver to participate in traffic in Vietnam?

Article 40 of the Draft Law on Traffic Safety and Order proposes the following minimum age for drivers as follows:

Age and health of drivers participating in road traffic

1. The age of drivers is specified as follows:

a) Persons who are 16 years old or older are allowed to drive motorcycles.

b) Persons who are 18 years old or older are eligible for a driver's license for class A2, A, A3, and B.

c) Persons who are 21 years old or older are eligible for a driver's license for class C1, C, and BE.

d) Persons who are 24 years old or older are eligible for a driver's license for class D2, C1E, and CE.

dd) Persons who are 27 years old or older are eligible for a driver's license for class D, D2E, and DE.

e) The maximum age of a professional driver of a passenger car with more than 30 seats is 50 years old for women and 55 years old for men.

2. The Ministers of National Defense and Public Security shall regulate the age of persons driving vehicles for national defense and security purposes.

3. Drivers participating in traffic must have health that is appropriate for the type of vehicle they are allowed to drive. The Minister of Health shall regulate the health standards, periodic health examinations for drivers, and the establishment of a database of driver health examinations.

Therefore, the new draft proposes that the minimum age for drivers participating in traffic is 16 years old. Specifically:

- Persons who are 16 years old are allowed to drive motorcycles.

- Persons who are 18 years old or older are eligible for a driver's license for class A2, A, A3, and B.

- Persons who are 21 years old or older are eligible for a driver's license for class C1, C, and BE.

- Persons who are 24 years old or older are eligible for a driver's license for class D2, C1E, and CE.

- Persons who are 27 years old or older are eligible for a driver's license for class D, D2E, and DE.

In addition, the maximum age of a professional driver of a passenger car with more than 30 seats is 50 years old for women and 55 years old for men.

Proposal: In what cases is training required to upgrade a driver license in Vietnam?

Article 41 of the Draft Law on Traffic Safety and Order proposes driver training as follows:

Driver training

1. Persons who meet the age and health requirements specified in Article 40 of this Law if they need to be issued a driver license must be trained according to the content and training program specified for each driver's license category.

2. The content of driver training includes: Theory; practical driving in the driving school yard; practical driving in road traffic.

At the end of the course, the driver is tested and issued a certificate of completion of the training program by the training institution.

3. Training to upgrade a driver license is carried out for the following cases:

a) Upgrading a driver license from class B to class C1 or to class C or to class D2;

b) Upgrading a driver license from class C1 to class C or to D2 or to class D;

c) Upgrading a driver license from class C to class D2 or to class D;

d) Upgrading a driver license from class D2 to class D;

dd) Upgrading a driver license from classes B, C1, C, D2, D to the corresponding driver's license categories BE, C1E, CE, D2E, DE.

4. Persons who need to be trained to upgrade a driver license under the provisions of Clause 3 of this Article must have the required safe driving time for each driver's license category; persons who need to be trained to upgrade a driver's license to class D2, D must have at least a junior high school education level.

5. Classes C1, C, D2, D and the categories BE, C1E, CE, D2E and DE must be trained in the form of upgrading training according to the conditions specified in Clauses 3 and 4 of this Article.

Therefore, the planned training to upgrade a driver's license is carried out in the following cases:

- Upgrading a driver license from class B to class C1 or to class C or to class D2;

- Upgrading a driver license from class C1 to class C or to D2 or to class D;

- Upgrading a driver license from class C to class D2 or to class D;

- Upgrading a driver license from class D2 to class D;

- Upgrading a driver license from classes B, C1, C, D2, D to the corresponding driver's license categories BE, C1E, CE, D2E, DE.

Proposal: What are conditions for driving test centers in Vietnam?

Clause 5 Article 41 of the Draft Law on Traffic Safety and Order proposes conditions for driving test as follows:

- Have sufficient conditions in terms of construction area, motor vehicles used for testing, equipment and must meet technical requirements according to National Technical Regulations on road motor vehicle driving test centers.

- Must use equipment, apply information technology and be subject to supervision of testing contents by the central agency managing training, testing and issuing driver's licenses.

Note: The Draft Law on Road Traffic Safety and Order is in the process of collecting comments and has not yet taken effect.
