Circular 32/2024/TT-BGTVT stipulating the management of road use service prices of road construction investment projects for business, under central management in Vietnam
On November 13, 2024, the Minister of Transport of Vietnam issued Circular 32/2024/TT-BGTVT regulating the management of prices, cases of exemptions, and reductions of road use service prices for road construction investment projects (except for expressway road use services) for business, managed by the central government.
Article 2 of Circular 32/2024/TT-BGTVT specifies the subjects and vehicle owners required to pay the road use service fees, including:
- The subjects required to pay road use service fees are road vehicles passing through toll stations of road construction investment projects for business managed by the central government (hereinafter referred to as vehicles).
- Organizations and individuals owning, using, or managing vehicles (hereinafter referred to as vehicle owners) subject to the obligation to pay road use service fees, except for cases exempted from road use service fees.

Who is exempted from paying road use service fees in Vietnam?
Based on Article 3 of Circular 32/2024/TT-BGTVT, the subjects exempted from paying road use service fees for road construction investment projects for business from January 1, 2025, include:
- Ambulances.
- Firefighting vehicles of the Fire Prevention, Fighting, Rescue, and Salvage Police force, and other firefighting vehicles mobilized for firefighting duties with priority signals as prescribed by law.
- Agricultural and forestry machinery, including tractors, plows, harrows, weeders, and threshers.
- Specialized vehicles serving national defense, including vehicles with a red background license plate, embossed white letters and numbers equipped with national defense-specific equipment, vehicles on emergency duty using one of the priority signals prescribed by law in urgent tasks.
- Specialized vehicles of units under the organizational system of the People's Public Security force, including:
+ Traffic patrol cars of the traffic police with features: rotating lights on the roof and the term "CẢNH SÁT GIAO THÔNG" printed on the sides of the car
+ Police cars 113 with the term "CẢNH SÁT 113" printed on the sides
+ Mobile police cars with the term "CẢNH SÁT CƠ ĐỘNG" printed on the sides
+ Transport vehicles with seats installed in the cargo area for the People's Public Security force performing tasks
+ Prisoner transport vehicles, rescue vehicles, and other specialized vehicles of the People's Public Security force
+ Special vehicles (satellite communication vehicles, bulletproof vehicles, anti-terrorism, anti-riot vehicles, and other special vehicles of the People's Public Security force)
+ Vehicles of the Police force on urgent duty using priority signals as prescribed by law
- Specialized vehicles serving funerals, including:
+ Vehicles with specialized funeral structures
+ Funeral vehicles are exclusively used for funeral activities, having vehicle registration certificates in the name of the funeral service unit. The funeral service unit provides a declaration of commitment that these types of vehicles are solely used for funeral activities to the electronic payment service provider
- Motorcades escorted by traffic police vehicles.
- Defense force vehicles participating in drills, mobile force deployments, and transport of weapons and equipment accompanied by military escort vehicles.
- Police and defense force vehicles using nationwide road tickets as prescribed.
- Dike protection vehicles; vehicles on emergency flood and storm prevention duty as directed by competent authorities.
- Vehicles transporting medicine, machinery, equipment, materials, and goods to disaster-stricken areas or epidemic zones under emergency regulations for major disasters and dangerous epidemics.
- Motorcycles, mopeds, and non-motorized vehicles.
On what basis is the maximum road use service price determined?
Based on Article 4 of Circular 32/2024/TT-BGTVT, which stipulates the pricing of road use services:
Article 4. Pricing of Road Use Services
- The maximum road use service price is determined based on principles and criteria stipulated in Article 22 of the Law on Pricing.
- The Vietnam Road Administration decides to apply pricing methods according to the provisions of the pricing law.
- When factors forming the road use service price change, affecting the maximum road use service price, the Vietnam Road Administration organizes the selection of Road Construction Investment Project Enterprises (Project Enterprises) to develop pricing plans.

Thus, the maximum road use service price is determined based on the following criteria:
- The price-forming factors of goods and services at the time of pricing or the period for determining the price-forming factors in the pricing plan, in accordance with the characteristics and nature of the goods and services
- The supply and demand relations of goods and services, market demand, the purchasing power of the currency; the consumer's ability to pay
- The domestic and global market prices and the competitiveness of goods and services.
