      Based on Article 2 of Decree No. 76/2019/ND-CP, the regulations are as follows:

      Applicable entities

      Officials, public employees, and employees in agencies, organizations, units of the Party, State, political - social organizations from central to local levels (hereinafter referred to as commune level) and those receiving salaries in the armed forces (including cases of mobilization, special missions, rotation, and no differentiation between locals and non-locals) who are placed on the salary scale prescribed by the competent authority of the Party and State, are working and stationed in areas with particularly difficult socio-economic conditions, including:

      1. Officials, public employees (including probationary personnel) in agencies, organizations, career units of the Party, State, political - social organizations from central to commune levels;

      Based on Article 4 of Decree No. 76/2019/ND-CP, the regulations are as follows:

      Attraction Allowance

      The subjects specified in Article 2 of this Decree are entitled to an attraction allowance equal to 70% of the current salary (according to the salary scale prescribed by the competent authority of the Party and State) plus leadership position allowance, seniority allowance exceeding the framework (if any) applicable for the actual working time in areas with particularly difficult socio-economic conditions not exceeding 05 years (60 months).

      Therefore, public employees working in areas with particularly difficult socio-economic conditions will receive the attraction allowance.

      According to this Article, the attraction allowance is equal to 70% of the current salary (according to the salary scale prescribed by the competent authority of the Party and State) plus leadership position allowance, seniority allowance exceeding the framework (if any) applicable for the actual working time in areas with particularly difficult socio-economic conditions not exceeding 05 years (60 months).

      Which entities are entitled to attraction allowances when working in areas with particularly difficult socio-economic conditions in Vietnam?

      Based on Article 2 of Decree No. 76/2019/ND-CP, the entities entitled to attraction allowances include:

      - Officials, and public employees (including trainees) in Party, State, and socio-political organizations from central to commune level;

      - Employees under labor contracts in Party, State, and socio-political organizations as regulated;

      - Professional officers, soldiers, employees, and defense officials, and laborers under state budget-funded salaries in the People's Army of Vietnam;

      - Officers, non-commissioned officers, police officers, and laborers under state budget-funded salaries in the People's Public Security;

      - Employees in essential organizations;

      - Employees in staffing quotas in organizations supported by state budget for operational expenses.

      What are regulations on the period of attraction allowances for working in areas with particularly difficult socio-economic conditions in Vietnam?

      According to Article 4 of Decree No. 76/2019/ND-CP, the allowance for attraction allowances applies to the actual working time in areas with particularly difficult socio-economic conditions, not exceeding 05 years (60 months).

      In addition, Article 13 of Decree No. 76/2019/ND-CP regulates the actual working time in areas with particularly difficult socio-economic conditions as a basis for calculating the entitlement to allowances and subsidies as follows:

      (1) The actual working time in areas with particularly difficult socio-economic conditions is the total time of working with mandatory social insurance contributions in areas with particularly difficult socio-economic conditions (if there is interrupted time without enjoying social insurance benefits, it will be accumulated), including:

      - Time working in Party, State, and socio-political organizations;

      - Time working in the People's Army, People's Public Security, and essential organizations.

      - The calculation of actual working time in areas with particularly difficult socio-economic conditions is as follows:

      - Calculated by month:

      + In case of having 50% or more of the actual working time in areas with particularly difficult socio-economic conditions according to the working regime regulated by the competent authority, the whole month will be counted;

      + In case of having less than 50% of the actual working time in areas with particularly difficult socio-economic conditions in a month, it will not be counted;

      + For teachers who meet 50% or more of the teaching hours in a month, the whole month will be counted;

      + Summer vacation time will be paid for teachers according to the regime regulated by the competent authority, including attracting allowances and preferential allowances based on the profession.

      - Calculated by year:

      + Less than 03 months will not be counted;

      + From 03 months to 06 months will be counted as 1/2 (one half) year of service;

      + Over 06 months will be counted as 01 year of service.

      (2) The following periods will not be counted for entitlement to allowances and subsidies regulated in this Decree, including:

      - Time on business trips, work, or study outside areas with particularly difficult socio-economic conditions for more than 01 month;

      - Continuous time of not receiving salary due to resignation for more than 01 month;

      - Time of not receiving salary while receiving social insurance benefits according to the regulations of social insurance law;

      - Time of temporary suspension of work, temporary detention, or temporary imprisonment.
