Educational Activities Not Compliant with the Training Format for Foreign Education Programs: What is the Penalty?

According to Clause 7, Article 11 of Decree 04/2021/ND-CP (Effective from March 10, 2021), the following provisions are stipulated:

A fine ranging from 20,000,000 VND to 30,000,000 VND shall be imposed for conducting educational activities that do not comply with the education period, training period, or training format applicable to foreign education programs.

Supplementary Penal Measures: Suspension of educational activities from 06 months to 12 months for violations stipulated in Clauses 7 and 8 of this Article.

Measures to Remedy Consequences:

Compulsory transfer of students who have been admitted and enrolled, ensuring their eligibility, to another educational institution that is legally permitted to conduct educational activities, or cancellation of the admission decision and refund of collected fees to the students if the transfer is not possible, for violations stipulated in Clauses 7 and 8 of this Article.

Note: The aforementioned fine levels are applied to administrative violations committed by organizations. For the same administrative violation, the fine imposed on individuals shall be half of the fine imposed on organizations.
