During disciplinary action, is it permitted to be sent abroad for teaching?
While under disciplinary action, can one be sent abroad to teach?
Based on Article 17 of Decree 86/2021/ND-CP, the criteria for Vietnamese citizens to be sent abroad to teach are as follows:
Possessing good political and ethical qualities (as certified by the direct managing authority).
Not being under disciplinary action or under criminal prosecution.
Having the appropriate qualifications and abilities matching the content, program for teaching, scientific research, and academic exchanges abroad.
Meeting other requirements of the program for teaching, scientific research, and academic exchanges abroad.
Receiving consent from the direct managing authority to be sent abroad.
Therefore, if you are currently under disciplinary action, you will not meet the criteria to be sent abroad to teach.
Rights of Vietnamese citizens teaching abroad
Based on Clause 1, Article 19 of this Decree, the rights of Vietnamese citizens teaching abroad are as follows:
a) To be protected by the representative office of Vietnam abroad regarding their legitimate rights and interests in accordance with Vietnamese law, the law of the host country, international law, and customary international practices during the period of teaching, conducting research, and participating in academic exchanges abroad;
b) To transfer salaries, wages, income, and other personal assets back to Vietnam in compliance with Vietnamese law and the law of the host country;
c) If they are personnel of an agency or organization funded by the state budget, to receive salary, wages, other income, medical examination, treatment policies, social insurance, and other benefits based on an agreement with the direct managing authority and to be reinstated to their position after completing their work abroad.
