Hello Lawnet. I am 25 years old this year. I am currently a high school teacher. I heard that the military service recruitment is in progress and I have a question. If I am conscripted and meet the conditions for military service, will the time of military service be counted as the time for seniority allowance?

Clause 1 Article 3 of Decree 77/2021/NĐ-CP stipulates the time period for calculating the seniority allowance as follows:
The time period for calculating the seniority allowance is determined by the total of the following periods:
a) Time spent teaching and educating with compulsory social insurance contributions in public educational institutions.
b) Time spent teaching and educating with compulsory social insurance contributions in non-public educational institutions (for teachers who are currently teaching and educating in public educational institutions but have previously taught and educated in non-public educational institutions).
c) Time spent working that is eligible for seniority allowance, including: time spent working that is classified according to one of the ranks or positions of the customs, judicial, prosecutorial, auditing, inspection, civil execution, forestry, national reserves, and party inspection professions; time spent working that is eligible for seniority allowance in the military, police, and central government agencies; and time spent working that is eligible for seniority in other industries (if any).
d) Time spent on compulsory military service under the law, provided that the teacher was eligible for seniority allowance before going on military service.
If you are currently teaching at a high school and are eligible for seniority allowance, but are called up to participate in compulsory military service, the period of your participation in the service will still be counted towards the time you are eligible for the seniority allowance.

Is the seniority allowance of teachers subject to social insurance contribution in Vietnam?
Article 4 of Decree 77/2021/NĐ-CP stipulates the amount of seniority allowance, as follows:
1. Teachers who participate in teaching and education with compulsory social insurance contributions for at least 5 years (60 months) are eligible for seniority allowance equal to 5% of their current salary plus the leadership position allowance and the seniority allowance exceeding the frame (if any). From the sixth year onwards, each year (12 months) is calculated at an additional 1%.
2. Seniority allowance is paid at the same time as monthly salary and is used to calculate social insurance, health insurance, and unemployment insurance contributions.
3. Calculation of the monthly amount of seniority allowance:
The seniority allowance = The salary coefficient according to the professional title of the civil servant plus the coefficient of the leadership position allowance, seniority allowance exceeding the frame (if any) currently enjoyed x The base salary is determined by the government for each period x The percentage of seniority allowance that is eligible
Therefore, the seniority allowance of teachers will be used to calculate contributions such as social insurance, health insurance, and unemployment insurance.
What is the source of funding for the seniority allowance for teachers in Vietnam?
Based on Clause 1 Article 5 of Decree 77/2021/NĐ-CP, the following sources of funding are stipulated:
1. The sources of funding for the implementation of the seniority allowance for teachers shall be used from the legal sources of the unit and the funding provided by the state budget, specifically:
a) For public educational institutions that are self-financing for both recurrent and capital expenditures and public educational institutions that are self-financing for recurrent expenditures: The funding for the implementation of the seniority allowance shall be guaranteed from the unit's non-profit revenue.
b) For public educational institutions that are self-financing for a part of recurrent expenditures: The funding for the implementation of the seniority allowance shall be guaranteed from the unit's non-profit revenue and the funding allocated by the state budget according to the current state budget management decentralization.
c) For public educational institutions that are state-funded for recurrent expenditures: The funding for the implementation of the seniority allowance shall be guaranteed by the state budget and allocated in the annual budget of the educational institution according to the current state budget management decentralization.
With this regulation, the sources of funding used to implement the seniority allowance for teachers are used from the sources mentioned above.
