Official: Commune-level police can grant Certificates of satisfaction of security and order conditions from August 15, 2023 in Vietnam

From August 15, 2023: Which business establishments shall commune-level police grant Certificates of satisfaction of security and order conditions in Vietnam?

Pursuant to Clause 3 Article 24 of the Decree 96/2016/NĐ-CP (amended Clause 6 Article 1 of the Decree 56/2023/NĐ-CP), the commune-level police grant Certificates of satisfaction of security and order conditions for following business establishments as follows:

- Accommodation business establishments with the size of 10 to 20 rooms;

- Business establishments providing services of using paintball guns; karaoke service business;

- Business massage services;

- Trading in pawn services;

- Trading in signaling equipment of vehicles with priority right; gas trading;

- A business establishment that is not an enterprise providing printing services;

- Non-business units with revenue from business activities subject to security and order conditions of district-level agencies and organizations.

Note: The commune-level police of the provinces and cities that are granted the Certificate of satisfaction of security and order conditions and the management of business establishments are not applicable to the business establishments specified at Clause 1.a, 2.a and Clause 4, Article 24 of Decree 96/2016/NĐ-CP.

Pursuant to Article 24 of the Decree 96/2016/NĐ-CP (amended Clause 7 Article 1 of the Decree 56/2023/NĐ-CP) stipulating competence of commune-level police regarding granting Certificates of satisfaction of security and order conditions and management of business establishments as follows:

Amending and supplementing a number of articles of Decree 96/2016/ND-CP dated July 1, 2016 stipulating security and order conditions for a number of conditional investment and business lines (has been amended and supplemented by Decree 31/2021/ND-CP)

7. Add Clause 4 after Clause 3, Article 24 as follows:

“4. Commune-level police are responsible for granting certificates of satisfaction of security and order conditions and managing business establishments, including: accommodation service establishments with a business scale of less than 10 rooms, establishments Gas business is a household business.”

Thus, from August 15, 2023, the commune-level police will have the authority to issue Certificates of eligibility for security, order and management of business establishments for:

- Accommodation service establishments with business scale of less than 10 rooms;

- Gas trading establishments are business households.

Which business establishments will be eligible to be issued with certificates of satisfaction of security and order conditions by the competent Police Department for administrative management of social order in Vietnam?

Pursuant to Clause 1.a Article 24 of the Decree 96/2016/NĐ-CP (amended Clause 5 Article 1 of the Decree 56/2023/NĐ-CP), the competent Police Department for administrative management of social order shall issue certificates of satisfaction of security and order conditions for following business establishments:

- Small-scale military firearms business establishments;

- Trading in industrial explosives and explosive precursors (except for transporting industrial explosives and explosive precursors);

- Trading in blasting services; providing accommodation services rated from 5 stars or more;

- Trading in supporting tools; selling paintball guns (providing services of using paintball guns);

- Casino business;

- Trading in prize-winning video games for foreigners;

- Foreign-invested security service business establishments and security service business establishments with the function of training security service personnel;

- Business establishments under the Ministry of Public Security.

Note: Decree 56/2023/NĐ-CP takes effect from August 15, 2023.
