Pursuant to Article 14 of Decree 96/2016/ND-CP (amended by Clause 2, Article 1 of Decree 56/2023/ND-CP) stipulating regulations on certificates of satisfaction of security and order conditions as follows:

Certificate of satisfaction of security and order conditions

Certificate of satisfaction of security and order conditions (Form No. 01 in the Appendix issued together with this Decree) is a document issued by a competent police agency to an investment and business establishment in the lines and trades specified in Article 3 of this Decree. A certificate of satisfaction of security and order conditions shall be issued to a business establishment in the form of a paper document or an electronic document with equivalent legal validity. At the request of the business establishment, the paper and electronic version shall be issued simultaneously when the Public Service Portal and the information system for handling administrative procedures of the Ministry of Public Security are completed and put into operation.

Thus, the certificate of satisfaction of security and order conditions is issued in electronic form or in paper form.

What are procedures for submitting an application for a Certificate of satisfaction of security and order conditions in Vietnam?

Pursuant to Clause 1, Article 23 of Decree 96/2016/ND-CP (supplemented by Clause 4, Article 1 of Decree 56/2023/ND-CP) stipulating procedures for submitting an application for a Certificate of satisfaction of security and order conditions in Vietnam as follows:

Step 1: The business establishment submits a dossier to the competent police agency to apply for a new, renewed or re-issued Certificate of satisfaction of security and order conditions.

Step 2:

At a business location with many different lines of business belonging to a business establishment but under the authority to issue Certificates of satisfaction of security and order conditions of different levels of the Public Security, then:

Submit a set of dossiers to the highest competent police agency to issue a Certificate of satisfaction of security and order conditions for those industries and professions;

At a business location with many different lines of business belonging to many different business establishments but under the authority to issue Certificates of satisfaction of security and order conditions of different levels of the Public Security, then:

Each business establishment shall submit a dossier to the highest competent police agency to issue a Certificate of satisfaction of security and order conditions for each business establishment;

- For branches and affiliated business establishments that have a business location other than that of the main business establishment that is not under the management competence of the police agency as prescribed in Clause 1, Article 24 of Decree 96/2016/ND-CP then:

Submit a dossier to the competent police agency where the branch or affiliated business establishment is located to be responsible for granting the Certificate of satisfaction of security and order conditions and for direct management.

From August 15, 2023: What are forms of application for issuance of Certificate of satisfaction of security and order conditions in Vietnam?

Pursuant to Clause 1 Article 23 of Decree 96/2016/ND-CP (supplemented by Clause 4, Article 1 of Decree 56/2023/ND-CP) stipulating forms of application for issuance of Certificate of satisfaction of security and order conditions in Vietnam as follows:

2. Forms of application submission:

Business establishments choose one of the following forms of application:

a) Submit directly to the competent police agency;

b) Submit via the public postal service;

c) Submit through the National Public Service Portal or the Public Service Portal of the Ministry of Public Security (except for documents and papers that are not allowed to be posted online as prescribed by law).

3. The time limit for completing the issuance of the Certificate of satisfaction of security and order conditions from the date of receipt of a complete and valid dossier is specified as follows:

a) No more than 05 working days for the case specified in Articles 19, 20 and Clauses 2, 3, 4, Article 22 of this Decree;

b) No more than 04 working days for the case of renewal or re-issuance specified in Article 21 and Clause 1, Article 22 of this Decree.

4. In case the Certificate of satisfaction of security and order conditions is not granted, within 04 working days from the date of receipt of the dossier, the police authority must send a written reply to the business establishment clearly stating that reason.

Thus, from August 15, 2023, there are 03 forms of application for the Certificate of satisfaction of security and order conditions, including:

- Submit directly to the competent police agency;

- Submit via the public postal service;

- Submit through the National Public Service Portal or the Public Service Portal of the Ministry of Public Security (except for documents and papers that are not allowed to be posted online as prescribed by law).

Note: Decree 56/2023/ND-CP takes effect from August 15, 2023.
