What documents are included in the application dossier for issuance digital certificates made by subscribers from 09/5/2024 in Vietnam?

Pursuant to Article 23 of the Decree 130/2018/ND-CP (amended by Clause 1 Article 1 of the Decree 48/2024/ND-CP), an application for a subscriber’s digital certificate shall include:

- A physical or electronic application form for digital certificate which is made using the form prescribed by the public digital signature certification body.

- Attached documents, including:

+ For an individual: Citizen identity card or identity card or identity certificate or passport or use of level-2 electronic identity account.

+ For an organization: Establishment decision or decision prescribing functions, tasks, powers and organizational structure or enterprise registration certificate or investment certificate and citizen identity card or identity card or identity certificate or passport of the legal representative of the organization; or use of electronic identity account of the organization.

- The applicant is entitled to choose between submitting a copy extracted from master register or certified true copy or copy presented with its original for verification purpose, or providing electronic data to the public digital signature certification body for use as prescribed in Clause 4 Article 23 of the Decree 130/2018/ND-CP.

- If an individual or an organization’s legal representative provides or uses information on citizen identity card or identity card or identity certificate or information on the individual’s level-2 electronic identity account or information on the organization’s electronic identity account, the public digital signature certification body (that has obtained a written approval for connection with the electronic identification and authentication system or has adequate equipment for reading data contained in chips or on level-2 electronic identity accounts) shall access and use data contained in chips, data on the individual’s level-2 electronic identity account or data on organization’s electronic identity account without requesting that individual or that organization's legal representative to provide the documents mentioned in Clause 3 Article 23 of the Decree 130/2018/ND-CP.

- Public digital signature certification bodies shall provide utilities or applications for electronically receiving applications.

What is the time limit for renewal of digital certificates to subscribers in Vietnam?

Pursuant to Article 23 of the Decree 130/2018/ND-CP stipulating renewal of digital certificates to subscribers:

Renewal of digital certificates to subscribers

1. At least 30 days prior to the expiration of the digital certificate, the subscriber may request for renewal of digital certificate.

2. Upon receiving a request for renewal, the public certification authority is obliged to complete the procedures for renewal of digital certificate before subscriber’s digital certificate expires.

3. In case of changing the public key on the digital certificates renewed, the subscriber must indicate clearly it in the written requests; the creation of key, key distribution and publication of renewed digital certificate shall comply with the provisions in Article 24, Article 25 of this Decree.

As regulated above, the time limit for renewal of digital certificates to subscribers in Vietnam is at least 30 days prior to the expiration of the digital certificate.

In which cases shall digital certificates of subscribers be suspended in Vietnam?

Pursuant to Clause 1 Article 28 of the Decree 130/2018/ND-CP, a digital certificate of subscriber shall be suspended in any of the following cases:

- When the subscriber requests in writing and the request was verified as accurate by the public certification authority;

- When the public certification authority has grounds to assert that the digital certificate issued not in compliance with the provisions of Article 24, Article 25 of the Decree 130/2018/ND-CP or detecting any errors that affect the interests of the subscriber and the recipients;

- Upon request of the agencies proceeding procedures, police authorities or the Ministry of Post and Telecommunications;

- As a condition to suspend digital certificate as stipulated in the contract between the subscriber and public certification authority.
