What are regulations on report on contract performance of enterprises providing public telecommunications services in Vietnam?

Pursuant to Clause 2 Article 44 of Circular 14/2022/TT-BTTTT (effective from December 12, 2022) stipulating report on contract performance of enterprises providing public telecommunications services in Vietnam as follows:

a) Enterprises performing a contract to provide public telecommunications services shall make a list of contract performance results and request the Department of Information and Communications to certify the beneficiaries of the Program in their localities before sending them to the Ministry of Information and Communications. The Vietnam Public Telecommunication Service Fund takes over, except for the contents specified at Point a, Clause 5 of this Article;

b) The time for enterprises to send reports on contract performance to the Vietnam Public Telecommunication Service Fund for acceptance is July 30 of each year (for the 6-month acceptance period) and January 31 of each year (for the annual acceptance period).

What are regulations on the confirmation of the Department of Information and Communications about the beneficiaries of the Program to provide local public telecommunications services in Vietnam?

Pursuant to Clause 3 Article 44 of Circular 14/2022/TT-BTTTT (effective from December 12, 2022) stipulating the confirmation of the Department of Information and Communications about the beneficiaries of the Program to provide local public telecommunications services in Vietnam as follows:

a) On the basis of the enterprise's report, based on information and data related to the subjects supported in providing and using universal telecommunications services in the locality, the Department of Information and Communications checks and certifies those supported to provide and use universal telecommunications services in the locality, ensuring the right audience, without duplication between businesses, and send the results to service providers and the Vietnam Public Telecommunication Service Fund as a basis for acceptance and payment.

During the certification process, if necessary, the Department of Information and Communications requests relevant local agencies to coordinate in checking and comparing when confirming the supported objects.

b) The time for certification is 15 days from the date of receipt of the enterprise's report.

What documents must be included in the pre-acceptance test to determine the performance of a contract for provision of public telecommunications services in Vietnam?

Pursuant to Clause 4 Article 44 of Circular 14/2022/TT-BTTTT (effective from December 12, 2022) stipulating document included in the pre-acceptance test to determine the performance of a contract for provision of public telecommunications services in Vietnam as follows:

a) Contract for provision of public telecommunications services;

b) The enterprise's report on the contract performance results of the enterprise, enclosed with a list of subjects who are provided with public-utility telecommunications services, made according to the form specified in Appendix II issued with this Circular; certified under Clause 3 of this Article.

c) Invoice of the supplier in case the enterprise uses outsourced services (if any).

What are regulations on the Vietnam Public Telecommunication Service Fund?

Pursuant to Clause 5 Article 44 of Circular 14/2022/TT-BTTTT (effective from December 12, 2022) stipulating the Vietnam Public Telecommunication Service Fund as follows:

a) Advance, pre-acceptance test results of contract performance:

- Data transmission service connecting information from the mainland to islands, island communes, island districts, sea rigs.

- Compulsory telecommunications services.

- Funding support to equip smart phones for poor and near-poor households.

- Universal telecommunications services for poor and near-poor households.

- Maritime mobile telecommunications service for fishermen fishing at sea.

b) Acceptance of service provision contract performance results of the enterprise on the basis of certification by the Department of Information and Communications and report on contract performance results of the enterprise;

c) Time limit for acceptance: The Vietnam Public Telecommunication Service Fund shall complete the pre-acceptance test of the contents specified at Points a and b of this Clause within 30 days from the date of receipt of complete application for acceptance;

d) The test and acceptance results shall be recorded in writing according to the provisions of Appendix VI issued with this Circular.
