What are conditions for merging and consolidating public service units in the field of information and communication in Vietnam?

Based on Article 6 of Circular 24/2021/TT-BTTTT (effective from 15/02/2022), the conditions for merging and consolidating public service units in the field of information and communication in Vietnam are as follows:

- The merger or consolidation of public service units is carried out when meeting the conditions specified in Clause 2 of Article 5 of Decree No. 120/2020/ND-CP.

- The public service unit formed after the merger or consolidation must meet all the establishment conditions specified in Article 6 of this Circular and the relevant laws and regulations.

- The level of financial autonomy of the public service unit after the merger or consolidation:

+ In cases where the merging or consolidating public service units have the same level of financial autonomy, the public service unit formed after the merger must ensure that its level of financial autonomy is not lower than the current level of financial autonomy of the units.

+ In cases where the merging or consolidating public service units have different levels of financial autonomy, the level of financial autonomy of the public service unit formed after the merger shall be determined by the decision of the competent authority.

What are conditions for establishing a public service unit in the field of information and communication in Vietnam?

The conditions for establishing a public service unit in the field of information and communication are regulated under Article 5 of the aforementioned Circular as follows:

- The establishment of a public service unit in the field of Information and Communication must meet the conditions specified in Clause 1 of Article 5 of Decree No. 120/2020/ND-CP.

- In addition to the general conditions specified in this Clause, the establishment of public service units in the field of Information and Communication must also meet the specific conditions stipulated by the current specialized laws and regulations (if applicable).

What are conditions for dissolution of a public service unit in the field of information and communication in Vietnam?

Under Article 7 of the aforementioned Circular, the conditions for dissolution of a public service unit in the field of information and communication are regulated as follows:

- The dissolution of a public service unit in the field of Information and Communication is carried out when meeting one of the conditions specified in Clause 3 Article 5 of Decree No. 120/2020/ND-CP and the provisions of the current specialized laws and regulations (if applicable).

- The public service unit can only proceed with dissolution after fulfilling obligations related to finance, assets, land, loans, and other relevant issues (if applicable), and receiving written confirmation from the competent authority or organization.
