What are conditions for exemption from radio frequency licensing in Vietnam?

Pursuant to Article 4 of the Circular 08/2021/TT-BTTTT stipulating conditions for exemption from radio frequency licensing in Vietnam as follows:

The use of a radio device shall be exempted from radio frequency licensing requirements if all of the following conditions are satisfied:

a) The radio device is included in the List provided in Appendix 1 enclosed herewith;

b) It meets the general requirements laid down in Article 6 of this Circular;

c) It meets corresponding technical and operation conditions specified in Appendix 2-20 enclosed herewith.

What are regulations on management and use of radio devices which are included the List but do not meet accompanying technical and operational conditions in Vietnam?

Pursuant to Clause 5, 12 and 24, Article 2 of the Circular 08/2021/TT-BTTTT stipulating as follows:

5. Radio Frequency Identification (RFID)

RFID uses the radio waves to automatically identify, manage and track goods, people and animals and have other applications.

RFID consists of a Radio Frequency tag and a Radio Frequency Reader which are connected to each other through the radio interface as follows:

- Radio Frequency tag (RF tag) has an electronic chip, with or without power source, and is attached to the object to be identified. The electronic chip contains information about the object to be identified.

- The Radio Frequency Reader (RF reader) generates signal at a determined frequency to activate the RF tag and read its response. The RF reader shall transmit the information received from the RF tag to the data processing system.

RFID has many applications in the fields of distribution, transportation and retailing, healthcare services, traffic or is used in mobile applications.

12. Radio devices placed on fishing vessels

Radio devices placed on fishing vessels are used to facilitate communications between fishing vessels operating within the territorial waters of Vietnam.

24. Low Power Wide Area Network (LPWAN) consists of sensors and devices transmitting and receiving sensor data which are connected to each other by means of radio interface, and use the spectrum shared with other short-range radio devices. The LPWAN devices prescribed in this Circular exclude those using the frequency bands granted license to use radio frequencies according to radio frequency planning (e.g.: LPWAN devices using NB-IoT, LTE-M…).

Besides, pursuant to Article 5 of the Circular 08/2021/TT-BTTTT stipulating management and use of radio devices which are included the List but do not meet accompanying technical and operational conditions in Vietnam as follows:

The radio devices which are included in the List provided in Appendix 1 enclosed herewith but do not meet accompanying technical and operation conditions provided in Appendix 2-20 enclosed herewith shall not be used in Vietnam, except the following devices which may be used under the license to use radio frequency and radio devices:

1. RFID operating in the 920-923 MHz frequency band and used for non-stop electronic toll collection stations with a radiated power above 500 mW ERP to 2000 mW ERP.

2. LPWAN devices operating in the 433,05-434,79 MHz frequency band with a radiated power above 25 mW ERP to 100 mW ERP and those operating in the 920-923 MHz frequency band with a radiated power above 25 mW ERP to 306 mW ERP.

3. Radio devices placed on fishing vessels operating on the frequencies outside the 26,96-27,41 MHz frequency band under the radio frequency planning.

4. Radio terminal devices used for safety and rescue purposes and operating on the frequencies prescribed by the international organizations to which Vietnam is a signatory or prescribed in the frequency use planning but not prescribed in this Circular.
