The issuance of Decree No. 49/2024/ND-CP regulating the grassroots information activities in Vietnam

On May 10, 2024, the Government of Vietnam promulgated Decree No. 49/2024/ND-CP, which regulates grassroots information activities.

This decree specifies the grassroots information activities, the state management responsibilities regarding grassroots information activities, and the rights and obligations of the agencies, organizations, and individuals involved in grassroots information activities.

The decree applies to ministries, ministerial-level agencies, government agencies, provincial People's Committees, district People's Committees, commune People's Committees, as well as agencies, organizations, and individuals participating in grassroots information activities.

What are the principles of grassroots information activities in Vietnam?

Article 4 of Decree No. 49/2024/ND-CP stipulates the principles of grassroots information activities as follows:

- Providing prompt, accurate, public, transparent, and suitable information that meets the level and needs of the people in each region, especially those in ethnic minority and mountainous areas, remote and far-reaching regions, border areas, and islands.

- Serving the guidance and administration of local  Communist Party of Vietnam committees and administrations.

- Ensuring the implementation of the Communist Party of Vietnam's and the State's policy communication tasks, providing essential information to the people.

- Ensuring that citizens are protected and treated equally without discrimination in exercising their right to access information.

- Respecting the contributions and opinions of the people; receiving feedback and information from competent agencies, organizations, and individuals regarding people's feedback.

- Adhering to legal provisions on ensuring security, order, social safety, protecting state secrets, and safeguarding the legitimate rights and interests of agencies, organizations, and individuals.

What is essential information in grassroots information in Vietnam?

Article 6 of Decree No. 49/2024/ND-CP stipulates the essential information within grassroots information as follows:

- Information about the Communist Party of Vietnam's guiding principles, policies, state laws, regulations of  Communist Party of Vietnam committees, and local authorities, as well as important events related to the local population.

- Information related to the local citizens includes:

+ Information about local economic, cultural, and social development projects and programs.

+ Information related to local political, economic, cultural, and social matters, as well as scientific, technical, and technological knowledge serving local socio-economic development.

+ Information related to local security, order, social safety, and military affairs.

+ Information about disaster prevention, search and rescue operations, firefighting, emergency response, disease outbreaks, and disasters occurring in or affecting the local area.

+ Information about exemplary individuals, good deeds, new talents, and notable advancements in various fields.

+ Information about measures taken to combat and prevent law violations and negative phenomena in society.

+ Information about essential products and services for local production and livelihoods.

- Other information as prescribed by laws on information access and laws on grassroots democracy implementation.

Which entities are responsible for publishing grassroots information bulletins in Vietnam?

According to Article 15 of Decree No. 49/2024/ND-CP, the entities responsible for publishing grassroots information bulletins include:

Communist Party agencies, state agencies, the Vietnamese Fatherland Front, and political-social organizations at the central, provincial, district, and commune levels.

What are the regulations regarding the content and form of non-commercial documents serving grassroots information activities in Vietnam?

According to Article 19 of Decree No. 49/2024/ND-CP, the regulations regarding the content and form of non-commercial documents serving grassroots information activities are as follows:

- Non-commercial documents serving grassroots information activities provide and disseminate essential information in Vietnamese, and ethnic minority languages at the local level, and raise characters for visually impaired individuals to promote and support political tasks.

- Non-commercial documents serving grassroots information activities are published in various forms, including printed books, braille books, leaflets, brochures, paintings, photographs, posters, audio recordings, and video recordings with content replacing books or illustrating books.

- Non-commercial electronic documents are published and distributed on public electronic bulletin boards, portals or websites, social media platforms, internet messaging applications, and other electronic information media as prescribed by laws on electronic information and related regulations.
