Insulting Others' Dignity on Facebook: Is a Fine of 5 Million VND Justified?
Based on Point a, Clause 1, and Clause 3, Article 101 of Decree 15/2020/ND-CP, the regulations are as follows:
A fine ranging from 10,000,000 VND to 20,000,000 VND shall be imposed for the act of exploiting social networks to provide, share fake information, false information, distortions, slander, insulting the reputation of agencies, organizations, or the honor and dignity of individuals.
According to this regulation, the act of exploiting social networks such as Facebook to share information that insults the honor and dignity of other individuals will be fined from 10,000,000 VND to 20,000,000 VND.
However, it should be noted that this regulation applies to organizations (Clause 3, Article 4 of this Decree), and in the case of individual violations, the fine is half that of the organization’s violation.
- Measures to remedy consequences: Required removal of false, misleading, or illegal information due to violations as specified in Clauses 1 and 2 of this Article.
Therefore, in the case of an individual posting information that insults another person's dignity on Facebook, being fined 5,000,000 VND is justified.
