Generating Additional Fees Beyond Service Charges When Porting Mobile Telecommunications Numbers: What Are the Penalties?

Based on Clause 1, Article 27 of Decree 15/2020/ND-CP (effective from April 15, 2020) prescribing violations of regulations on mobile number portability for terrestrial mobile telecommunications as follows:

- Fines ranging from VND 80,000,000 to VND 100,000,000 shall be imposed for one of the following acts if violating the regulations on porting numbers from 01 to 05 subscribers:

+ Refusing to port numbers outside of the permissible cases;

+ Not following the correct procedures for number porting;

+ Incurring charges beyond the service fee for number porting when porting terrestrial mobile telecommunications numbers.

Additionally, Point a, Clause 4, Article 27 of this Decree stipulates remedies as follows:

- Forcing the return or repayment of incorrectly collected fees for violations specified in point c of Clause 1 and Clause 2 of this Article;

=> Thus, your above-mentioned case will be fined from VND 80,000,000 to VND 100,000,000 and a forced return or repayment of incorrectly collected fees for the violation.
