General principles and scope of information provided to the Association/Fund database in Vietnam

1. General principles in provision of association/fund database in Vietnam

Pursuant to Article 3 of Regulation on management, operation, update, and use of the Association/Fund database promulgated together with Decision 79/QD-BNV in 2022, there are provisions on general principles in provision of association/fund database as follows:

1. Information on association and fund records that are updated in the Association/Fund database must be consistent with the documents and electronic records being stored at the unit as well as the copies provided for the Department of Non-Organization affiliated to Ministry of Home Affairs.

2. The Association/Fund database must be updated and supplemented on a regular basis, in a timely, complete and accurate manner, and managed and used according to the public regime (except for cases where it is marked confidential by the Party, State and Regulations of the Ministry of Home Affairs) and connected to the Database of the Ministry of Home Affairs to meet the needs of digital transformation.

3. Regularly monitor, check and take measures to ensure the safety of information about the Association/Fund database and ensure compatibility throughout the system when there is a change in technology and equipment.

4. It is strictly forbidden to take advantage of the acts of provision, update, use of information on the Association/Fund database of the Ministry of Home Affairs for the purpose of opposing the Party, the State and the interests of the people, violating the law, infringing upon the legitimate rights and interests of organizations and individuals; harming national security, peace and security.

2. Scope of information provided to the Association/Fund database in Vietnam

Pursuant to Article 4 of Regulation on management, operation, update, and use of the Association/Fund database promulgated together with Decision 79/QD-BNV in 2022, scope of information provided to the Association/Fund database is specified as follows:

1. All information under the management authority of the Ministry of Home Affairs about associations and funds will be stored and kept in the Association/Fund database, except for information in the categories of "Confidential", "Secret", "Top Secret" of the Party, State and Ministry of Home Affairs.

2. The relevant units and associations and funds are responsible for synthesizing and collecting information specified in Article 5 of this Regulation and updating it into the Association/Fund database in accordance with the law and provisions of this Regulation.
