Which titles are eligible for a state-level funeral in Vietnam?
Pursuant to Article 21 of Decree 105/2012/ND-CP, the titles eligible for a State funeral are stipulated as follows:
Article 21. Titles Eligible for a State Funeral
- Officials holding or having formerly held one of the following positions at the time of passing shall be eligible for a State funeral:
a) Member of the Politburo, Secretary of the Central Committee of the Communist Party;
b) Vice President of the Socialist Republic of Vietnam;
c) Deputy Prime Minister of the Government of Vietnam;
d) Vice Chairman of the National Assembly of the Socialist Republic of Vietnam;
dd) Chairman of the Central Committee of the Vietnam Fatherland Front;
e) Chief Justice of the Supreme People's Court;
g) Prosecutor General of the Supreme People's Procuracy;
h) General of the People's Armed Forces;
i) Lieutenant General of the People's Armed Forces who are revolutionary activists before August 1945.
- In the case where a person holding one of the positions stipulated in Clause 1 of this Article is disciplined, the organization of the funeral is regulated as follows:
The funeral is organized in the form of funeral for officials and public employees in the case of being disciplined by dismissal.
The titles receiving a State funeral upon passing include:
- Member of the Politburo, Secretary of the Central Committee of the Communist Party
- Vice President of the Socialist Republic of Vietnam
- Deputy Prime Minister of the Government of Vietnam
- Vice Chairman of the National Assembly of the Socialist Republic of Vietnam
- Chairman of the Central Committee of the Vietnam Fatherland Front
- Chief Justice of the Supreme People's Court
- Prosecutor General of the Supreme People's Procuracy
- General of the People's Armed Forces
- Lieutenant General of the People's Armed Forces who are revolutionary activists before August 1945
Note: If the above positions are disciplined, the funeral is organized in the form of funeral for officials and public employees in the case of being disciplined by dismissal.

According to Article 26 of Decree 105/2012/ND-CP, the location for organizing the funeral and burial is stipulated as follows:
Article 26. Location for Organizing the Funeral and Burial
- The State funeral is organized at the National Funeral Home, No. 5 Tran Thanh Tong, Hanoi (if organized in Hanoi); the Funeral Home of 175 Military Hospital or the Funeral Home, No. 25 Le Quy Don, District 3, Ho Chi Minh City (if organized in Ho Chi Minh City).
- Burial at Mai Dich Cemetery, Hanoi; Cemetery of Ho Chi Minh City or cremation, electro-cremation; burial at the homeland or another local cemetery according to the wishes of the family.
The State funeral is organized at the National Funeral Home, No. 5 Tran Thanh Tong, Hanoi (if organized in Hanoi); the Funeral Home of 175 Military Hospital or the Funeral Home, No. 25 Le Quy Don, District 3, Ho Chi Minh City (if organized in Ho Chi Minh City).
Who is the Head of the State Funeral Committee in Vietnam?
Based on Article 23 of Decree 105/2012/ND-CP, the State Funeral Committee and the Funeral Organizing Committee are regulated as follows:
Article 23. State Funeral Committee and Funeral Organizing Committee
- The Secretariat of the Central Committee of the Communist Party decides to establish the State Funeral Committee, comprising 20 (twenty) to 25 (twenty-five) members representing the Politburo, Central Committee, National Assembly, President, Government of Vietnam, Central Committee of the Vietnam Fatherland Front, the agency where the deceased worked or served, and the local home or birthplace of the deceased.
a) The State Funeral Committee is responsible for directing the organization of the State funeral in accordance with this Decree;
b) The head of the State Funeral Committee is a member of the Politburo; Vice President, Deputy Prime Minister of the Government of Vietnam, or Vice Chairman of the National Assembly.
- The Secretariat of the Central Committee of the Communist Party decides to establish the Funeral Organizing Committee, including 10 (ten) to 15 (fifteen) members representing various Ministries, Committees, sectors at the Central, local home, or birthplace of the deceased and family representatives.
a) The Funeral Organizing Committee assists the State Funeral Committee in managing the member agencies of the Funeral Organizing Committee and other agencies involved in organizing the State funeral according to the provisions of this Decree;
b) Depending on the title of the deceased, the head of the funeral organizing committee is one of the comrades such as Chief of Office of the Central Committee of the Communist Party; Head of Office of the President; Minister, Head of Office of the Government of Vietnam; Head of Office of the National Assembly or Chief of Office of the agencies with titles stipulated in Article 21 of this Decree.
According to the above regulations, the head of the State Funeral Committee is a member of the Politburo; Vice President, Deputy Prime Minister of the Government of Vietnam, or Vice Chairman of the National Assembly.
