What is the significance of December 16?

Following the success of the August Revolution, on September 2, 1945, at Ba Dinh Square in Hanoi, President Ho Chi Minh, on behalf of the provisional Government of Vietnam, delivered the Declaration of Independence, establishing the Democratic Republic of Vietnam, the first people's state in Southeast Asia.

The newly established revolutionary government had to face myriad difficulties and challenges. In the South, French colonialists, under the guise of British troops, returned to invade our country once again.

Using the pretext of disarming the Japanese army, over 200,000 troops under General Chiang Kai-shek's command, along with reactionary factions, swarmed into the North, actively sabotaging the Vietnamese revolution. This came alongside a devastating famine and widespread illiteracy resulting from years of feudal colonial oppression.

To meet the strategic operations directive requirements, on October 15, 1945, President Ho Chi Minh signed a decree establishing War Zone 4.

After a short period of preparation, on December 16, 1945, along with the Military Command and the agencies of the War Zone, the Political Department was established. Comrade Tran Van Quang was appointed as Head of the Department, and several officers and staff were mobilized from localities and liberation army units.

Thus, December 16 annually is the traditional day of the Political Department of Military Region 4.

Pursuant to Article 15 of the 1999 Law on Officers of the Vietnam People's Army (amended by Clause 3, Article 1 of the 2014 Amendment to the Law on Officers of the Vietnam People's Army), the highest military rank for an officer's position is stipulated as follows:

Article 15. Highest military ranks for officer positions

  1. The highest military ranks for officer positions are stipulated as follows:

a) General:

Minister of National Defense;

Chief of the General Staff; Director of the General Political Department;

b) Senior Lieutenant General, Admiral:

Deputy Ministers of National Defense with the highest military rank of Senior Lieutenant General, Admiral not exceeding six;

Deputy Chiefs of the General Staff, Deputy Directors of the General Political Department: each position with the highest military rank of Senior Lieutenant General not exceeding three;

Director, Political Commissar of the National Defense Academy;

c) Lieutenant General, Vice Admiral:

Commander, Political Commissar: Military Regions, Services, Border Defense Forces; Chief of General Department, General Department Director, Political Commissar of General Department; Head of the Cryptography Committee under the Prime Minister of Vietnam;

Commander, Political Commissar of the Command: Hanoi Capital, Ho Chi Minh City, Vietnamese Coast Guard;

Directors, Political Commissars of Academies: Military, Political, Technical, Logistics, Military Medical;

According to the above regulation, the highest military rank for a Commander of a Military Region in the Vietnam People's Army is Lieutenant General, Vice Admiral.

Who has the authority to appoint a Commander of the Military Region in Vietnam?

Pursuant to Article 25 of the 1999 Law on Officers of the Vietnam People's Army (amended by Clause 5, Article 1 of the 2014 Amendment to the Law on Officers of the Vietnam People's Army), the authority to decide on officer appointments is stipulated as follows:

Article 25. Authority in decisions regarding officers

  1. The authority to appoint, dismiss, relieve, promote, demote, strip military ranks for officers is stipulated as follows:

a) The President appoints, dismisses, relieves the Chief of the General Staff, Director of the General Political Department; promotes, demotes, strips generals, Rear Admirals, Vice Admirals, Admirals of the Navy;

b) The Prime Minister of Vietnam appoints, dismisses, relieves Deputy Ministers; Deputy Chiefs of the General Staff, Deputy Directors of the General Political Department; Directors, Political Commissars of the National Defense Academy; Chiefs of General Departments, General Department Directors, Political Commissars of General Departments; Commanders, Political Commissars of Military Regions; Commanders, Political Commissars of Services; Commanders, Political Commissars of Border Defense Forces; Commanders, Political Commissars of the Vietnamese Coast Guard; Head of the Cryptography Committee under the Prime Minister of Vietnam, and other positions as regulated by competent authorities;

c) The Minister of National Defense appoints, dismisses, relieves other positions, and promotes, demotes, strips other military ranks and elevates officer salaries;

d) The appointment, dismissal, and removal of positions in the military's inspection, court, and execution sectors are carried out in accordance with the law.

  1. Authorities competent to appoint to a position have the power to dismiss, relieve, demote, decide on extending the service period, mobilize, second, assign lower positions, release from service, transfer, and demobilize reserve officers to that position.

According to the above regulation, the Prime Minister of Vietnam has the authority to appoint, dismiss, and relieve the Commander of a Military Region of the Vietnam People's Army.
