What are regulations on the process of implementing the reporting regime on the Information and Reporting System of the Ministry of Science and Technology of Vietnam?

Pursuant to Article 11 of the Circular 13/2021/TT-BKHCN stipulating the process of implementing the reporting regime on the Information and Reporting System of the Ministry of Science and Technology of Vietnam as follows:

1. Periodically on November 25 every year, the Ministry of Science and Technology creates a report request on the System and sends it to the Ministries, branches, Provincial People's Committee, National University, Management Board of High-Tech Park.

2. Ministries, branches, provincial-level People's Committees, National Universities and High-Tech Park Management Boards shall follow the process as follows:

a) When receiving a request to report on the System, ministries, branches, provincial-level People's Committees, National Universities, and High-Tech Park Management Boards shall assign affiliated agencies and units to assume the prime responsibility for reporting.

b) The unit assumes the prime responsibility for, and coordinates with relevant units in, data entry and synthesis of reports; submit it to ministries, branches, provincial-level People's Committees, national universities and hi-tech park management boards for approval and send digitally signed reports as prescribed in Article 8 of this Circular to the Ministry of Science and Technology.

3. The Ministry of Science and Technology shall inspect, approve the report or return the report if the report does not meet the requirements, update, summarize and send a report to the Government or the Prime Minister.

What are responsibilities of the Ministry of Science and Technology of Vietnam in the periodical reporting regime within the scope of its state management?

Pursuant to Article 12 of the Circular 13/2021/TT-BKHCN stipulating responsibilities of the Ministry of Science and Technology of Vietnam in the periodical reporting regime within the scope of its state management as follows:

1. Publish the list of periodical reports specified in legal documents promulgated by the Ministry of Science and Technology or advised to promulgate according to the provisions of Clause 3, Article 30 of Decree No. 09/2019/ND-CP.

2. Review and evaluate regulations on the implementation of the reporting regime according to its competence to amend and supplement or propose amendments and supplements to suit the management scope of the Ministry of Science and Technology, and the principles and requirements of Decree No. 09/2019/ND-CP and this Circular.

3. Implement and operate the Information and Reporting System of the Ministry of Science and Technology; organize the connection, integration and synchronization of reporting data with the Government Reporting Information System.

4. Monitor and urge Ministries, branches, provincial People's Committees, National Universities and Hi-Tech Park Management Boards to implement the periodical reporting regime under the management of the Ministry of Science and Technology.

5. Units directly under the Ministry of Science and Technology are responsible for:

a) Assume the prime responsibility for, and coordinate with the Legal Department and the Ministry's Office in, implementing the provisions of Clause 2 of this Article;

b) Data entry (for data directly managed by the unit); synthesize reports from reporting agencies, submit them to the leaders of the Ministry of Science and Technology (via the Ministry's Office) to report to the Government and the Prime Minister.

6. The Ministry's Office shall assume the prime responsibility for, and coordinate with relevant units in, the implementation of provisions in Clauses 1 and 4 of this Article.

7. The Legal Department is responsible for guiding the units affiliated to the Ministry in the process of elaborating draft legal documents that stipulate the periodical reporting regime under the management of the Ministry of Science and Technology in accordance with regulations of the law.

8. Information Technology Center is responsible for:

a) Assume the prime responsibility for implementing the provisions of Clause 3 of this Article;

b) Develop regulations on operation, exploitation and use of the System, guidance documents, the exploitation and use of the System;

c) Delegate the right to exploit and use the System for reporting entities and units under the Ministry of Science and Technology;

d) Promptly handle when detecting or being notified by agencies, units or individuals about the System having errors or technical problems.

What are responsibilities of ministries, branches and provincial-level People's Committees in implementing the periodical reporting regime within the scope of state management of the Ministry of Science and Technology of Vietnam?

Pursuant to Article 13 of the Circular 13/2021/TT-BKHCN stipulating responsibilities of ministries, branches and provincial-level People's Committees in implementing the periodical reporting regime within the scope of state management of the Ministry of Science and Technology of Vietnam as follows:

1. Strictly, fully and properly implement the reporting procedures and deadlines. The information and data reported must be accurate, objective, truthful and reflect reality.

2. Assign specialized agencies and units under ministries, branches, provincial-level People's Committees, national universities, and hi-tech park management boards to make reports in accordance with each reporting regime. Assign cadres, civil servants and public employees with appropriate capacity and expertise to perform reporting work.

3. Notify the Ministry of Science and Technology (Information Technology Center) immediately after detecting that the System has errors or technical problems leading to affecting the operation or information security and safety of the System.
