The Ministry of Health of Vietnam issued a list of positions for professional civil servants in the medical field that will be effective from December 22, 2023
On November 6, 2023, the Minister of Health of Vietnam issued Circular 19/2023/TT-BYT guiding on positions for professional civil servants in the medical field. The list of positions for professional civil servants in the medical field will be effective from December 22, 2023.
Pursuant to Article 2 of Circular 19/2023/TT-BYT, this circular applies to administrative agencies that perform the function of advising and state management of the medical industry and sector from central to local levels. Specifically as follows:
- Administrative agencies and organizations under the Ministry of Health and administrative agencies and organizations under the Ministries and ministerial agencies that assist the Minister. Head of ministerial agency to manage the state on the medical industry and sector.
- Specialized agencies that perform the function of advising and assisting the People's Committee of provinces, central-affiliated cities to manage the state on health.
- Specialized agencies that perform the function of advising and assisting the People's Committees of districts, towns, districts, cities of provinces, central-affiliated cities to manage the state on health.

What are principles and grounds of the determination of positions for professional civil servants in the medical field in Vietnam?
Based on Article 3 of the Circular 19/2023/TT-BYT, the determination of positions for professional civil servants in the medical field is based on the following principles and grounds:
Principles and grounds for determining positions for professional civil servants in the medical field
1. Principles for determining positions for professional civil servants in the medical field are carried out in accordance with the provisions of Article 3 of Government Decree No. 62/2020/ND-CP dated June 1, 2022 on positions and civil service cadres (hereinafter referred to as Decree No. 62/2020/ND-CP).
2. Grounds for determining positions for professional civil servants in the medical field are carried out in accordance with the provisions of Article 4 of Decree No. 62/2020/ND-CP.
3. The determination of positions must ensure that the number of civil service positions does not increase beyond the number approved by the competent authority.
As regulations above, the determination of positions for professional civil servants in the medical field is based on the following principles and grounds
(1) Principles for determining positions for professional civil servants in the medical field are as follows:
- Compliance with the provisions of the Party and the law on positions, management, and use of civil service positions.
- Consistency with the functions, tasks, powers, and organizational structure of the agency or organization.
- Guaranteeing the unity and consistency between determining positions, the civil service grade structure, and the use and management of civil service positions.
- Guaranteeing scientificity, objectivity, openness, transparency, democracy, and compliance with reality.
- Linking the reduction of civil service positions with the restructuring and improving the quality of the civil service workforce in agencies and organizations.
(2) Grounds for determining positions for professional civil servants in the medical field are as follows:
- The functions, tasks, powers, and organizational structure of the agency or organization;
- The complexity, nature, characteristics, scale of activities; scope, beneficiaries; and professional and technical management procedures in accordance with the provisions of specialized laws.
(3) The determination of positions must ensure that the number of civil service positions does not increase beyond the number approved by the competent authority.
