Officially repeals some legal documents issued by the Minister of Health of Vietnam from January 1, 2024
On November 14, 2023, the Minister of Health of Vietnam issued Circular 20/2023/TT-BYT (effective from January 1, 2024) repealing some legal documents issued by the Minister of Health.
According to Article 1 of Circular 20/2023/TT-BYT, it repeals all 05 legal documents issued by the Minister of Health. Specifically, the following documents are repealed:
(1) Directive 06/2008/CT-BYT on strengthening the quality of human resources for health.
(2) Decision 379/2002/QĐ-BYT promulgating the regulations on health statistics.
(3) Circular 29/2014/TT-BYT on the forms and reporting system for health statistics applicable to private medical examination and treatment facilities.
(4) Circular 19/2015/TT-BYT on the inspection, handling, review, and systematization of legal documents in the field of state management of the Ministry of Health.
(5) Circular 30/2015/TT-BYT on the importation of medical equipment.

What legal documents were partially repealed under Circular 20 of 2023 of the Ministry of Health of Vietnam?
At Article 2 of Circular 20/2023/TT-BYT (effective from January 1, 2024), the Ministry of Health repeals a part of 05 legal documents issued by the Minister of Health as follows:
(1) Repealed Article 8, 12, 13, 14, 15, 16 and 17 of Circular 17/2001/TT-BYT guiding foreign-owned enterprises to register for activities related to drugs and drug ingredients in Vietnam.
(2) Repealed Clause 5 of Section 2, Section 3, Section 4 and Section 5 of Circular 10/2003/TT-BYT guiding foreign companies to register for activities related to vaccines, medical biological products with Vietnam.
(3) Repealed the content related to the import of in vitro diagnostic reagents in Circular 47/2010/TT-BYT guiding the export, import of drugs and packaging in direct contact with drugs.
(4) Repealed Clause 4 Article 1 of Circular 47/2011/TT-BYT amending and supplementing some articles of Circular 17/2001/TT-BYT dated August 1, 2001 of the Minister of Health guiding foreign-owned enterprises to register for activities related to drugs and drug ingredients in Vietnam and Circular 10/2003/TT-BYT dated December 16, 2003 of the Minister of Health guiding foreign companies to register for activities related to vaccines, medical biological products with Vietnam.
(5) Repealed Clause 1.b Article 9 of Circular 29/2015/TT-BYT regulating the issuance and reissuance of the Certificate of being a Traditional Medicine Practitioner.

a) Formulate and promulgate, or request competent authorities to promulgate, specialized regulations, national standards and national technical regulations on traditional medicine;
b) Formulate and request competent authorities to promulgate mechanisms and policies on inheritance, preservation, development and modernization of traditional medicine, and combined traditional and modern medicine;

As regulations above, tasks and power of Ministry of Health of Vietnam regarding traditional medicine are:
- Formulate and promulgate, or request competent authorities to promulgate, specialized regulations, national standards and national technical regulations on traditional medicine;
- Formulate and request competent authorities to promulgate mechanisms and policies on inheritance, preservation, development and modernization of traditional medicine, and combined traditional and modern medicine;
- Formulate and promulgate the list of controlled rare and precious herbs; develop herb farming areas and organize the implementation of measures for conservation, exploitation and rational and sustainable use of herbal resources;
- Issue, modify, re-issue and revoke practicing certificates in traditional medicine of persons working in its affiliated health facilities, and those working in health facilities affiliated to other ministries (except the Ministry of National Defence of Vietnam), and foreigners practicing in traditional medicine in Vietnam; issue, re-issue, modify and revoke operating licenses of its affiliated traditional medicine facilities, private traditional medicine hospitals or traditional medicine facilities affiliated to other ministries (except the Ministry of National Defence of Vietnam) in accordance with regulations of law;
- Issue, extend, modify and revoke marketing authorizations for herbal materials and traditional drugs in accordance with regulations of law; issue, re-issue, modify and revoke certificate of eligibility for pharmacy business to/of herbal materials and traditional drugs trading establishments; GACP (Good Agricultural and Collection Practices) certificates in accordance with regulations of law;
- Issue and re-issue certificates of approval of advertising contents for traditional medicine services; certificates of approval of information and advertising contents for traditional drugs and modifications thereof in accordance with regulations of law;
- Direct, instruct and inspect the implementation of mechanisms, policies, legislative documents, specialized regulations and national technical regulations on traditional medicine, and combined traditional and modern medicine.
