Not Subject to Disciplinary Review, Can the Official Receive the Remaining Salary?
According to Clause 2, Article 24 of Decree No. 34/2011/ND-CP on the regulation of the Regime and policies for officials during the period of temporary detention, custody, or suspension from work:
In cases where officials are not disciplined or are concluded to be wrongfully accused, they are entitled to retroactive payment of the remaining 50% of their current salary according to their rank and grade, along with the leadership position allowance, above-scale seniority allowance, professional seniority allowance, and the reserved salary difference coefficient (if any) during the period of work suspension, or temporary detention, custody.
Thus, if officials are not disciplined, they are entitled to retroactive payment of the remaining 50% of their salary according to the rank prescribed in Decree No. 34/2011/ND-CP.
