What are job positions in the industry and trade sector subject to periodic rotation in Vietnam from February 21, 2025?
On December 30, 2024, the Minister of Industry and Trade of Vietnam issued Circular 41/2024/TT-BCT stipulating the list and periodic transfer period of positions for officials and public employees directly interacting and handling work in the Industry and Trade sector at the local level.
In Article 2 of Circular 41/2024/TT-BCT, the list of positions in the Industry and Trade sector subject to periodic transfer includes:
[1] Issuing licenses related to import-export, trade services:
- Certificate of eligibility for merchants dealing in buying and selling LPG/LNG/CNG
- Certificate of eligibility for retail LPG stations into bottles
- Certificate of eligibility for retail gasoline stations
- Certificate of eligibility to operate as a retail gasoline agent
- Receipt of notice for gasoline business by small-scale gasoline distribution equipment- Wholesale license for alcohol in the province, centrally governed city
- Retail license for alcohol
- Wholesale license for tobacco products
- Retail license for tobacco products
- License to establish representative offices of foreign traders in Vietnam
- Business license, license to establish retail outlets of economic organizations with foreign investment in Vietnam
- Electricity distribution operation license up to 35 kV at the local level
- Retail electricity operation license up to 0.4 kV at the local level
[2] Issuing licenses related to ensuring safety standards in production, business:
- License for operations within the protection boundaries of hydroelectric dams, reservoirs
- Certificate of eligibility for production of explosive precursors
- Certificate of eligibility for producing/selling/producing and selling conditional chemicals in the industrial sector- License to use industrial explosives
- Certificate of safety training for using industrial explosives for persons involved in using industrial explosives
- Certificate of safety training for explosive precursors for those in charge of managing storage, places storing explosive precursors
- Certificate of establishment meeting food safety conditions
- Certificate of eligibility for LPG bottling stations into bottles
- Certificate of eligibility for LPG bottling stations into tank trucks
- Certificate of eligibility for LPG/LNG/CNG filling stations for transportation vehicles
- License for crafting alcohol for business purposes
- License for industrial alcohol production (scale under 3 million liters/year)
- Electricity generation operation license for power plants with capacities under 3 MW located at the local level
- Notification confirming the product, group 2 goods announcement in line with corresponding technical standards. Notification of receipt of files for conformity announcement for products, goods in line with national technical standards

What is the duration for periodic position rotation in the field of industry and trade in Vietnam?
Based on Article 3 of Circular 41/2024/TT-BCT stipulating the periodic transfer interval for positions:
Article 3. Periodic Transfer Interval for Positions
- The periodic transfer interval for positions for officials and public employees directly interacting and handling work as specified in Article 2 of this Circular is from 3 years to 5 years.
- The calculation of the transfer period for positions starts from the time of the document for assignment, positioning, task allocation by the competent authority according to the management hierarchy.
The periodic transfer interval for positions in the Industry and Trade sector is from 3 years to 5 years.
What are principles for position transfers in Vietnam?
Based on Article 24 of Anti-Corruption Law 2018 stipulating the principles for position transfers:
- Agencies, organizations, and units with competency are responsible for periodically transferring positions for officials not holding leadership or management positions and public employees within their agencies, organizations, and units for corruption prevention. The transfer of officials holding leadership or management positions is conducted according to the regulations on officer rotation.
- Position transfers must ensure objectivity, rationality, align with professional skills, and not affect the regular operations of agencies, organizations, and units.
- Position transfers must be conducted according to a plan and publicized within the agency, organization, or unit.
- The periodic transfer of positions for officials and public employees must not be exploited for personal gain or to suppress officials and public employees.
- The above regulation also applies to the following individuals who do not hold leadership or management positions:
+ Officers, professional soldiers, employees, and public employees in defense organizations and units within the Army;
+ Officers, rank and file officers in professional technical positions, and police employees in departments and units within the People’s Police.
