Inclusion of Sick Leave in the Probation Period of Officials
At Point c, Clause 2, Article 20 of Decree 138/2020/ND-CP, it is stipulated as follows:
The period of maternity leave according to social insurance benefits, sick leave of 14 days or more, unpaid leave, time spent in detention, temporary suspension according to the provisions of the law shall not be counted towards the probationary period.
In cases where the probationer takes sick leave or has a valid reason for less than 14 days and is approved by the head of the agency or unit where the person on probation is implementing the probation policies, this time may be counted towards the probationary period.
=> Thus, according to the aforementioned regulations, sick leave of 14 days or more will not be counted towards the probationary period. However, if sick leave is less than 14 days, with hospital confirmation and the head of the unit's consent, that time will still be counted towards the probationary period.
