In Vietnam: Which authorities shall the Department of Dyke Management and Flood, Storm Control (DDMFSC) be affiliated to?

Pursuant to Article 1 of the Decision 479/QĐ-BNN-TCCB in 2023 stipulating as follows:

Positions and functions

1. DDMFSC is an organization affiliated to the Ministry of Agriculture and Rural Development, on the basis of reorganization and improvement of Vietnam Disaster Management Authority. DDMFSC shall assist the Minister of Agriculture and Rural Development in managing the State and enforcing laws on dyke and natural disaster management nationwide.

2. DDMFSC has the status of a legal entity, has its own seal and account and has operational funds as prescribed by law.

3. The headquarters of DDMFSC is located in Hanoi.

As regulations above, DDMFSC is an organization affiliated to the Ministry of Agriculture and Rural Development in Vietnam.

What are rights and responsibilities of DDMFSC regarding response to natural disasters and dyke management in Vietnam?

Pursuant to Clause 6 and 9, Article 2 of the Decision 479/QĐ-BNN-TCCB in 2023 stipulating rights and responsibilities of DDMFSC regarding response to natural disasters and dyke management as follows:

- Regarding response to natural disasters:

+ Submit decisions on disclosing emergencies relating to natural disasters that befell works and material facilities under management of the Ministry and measures applied in the emergencies according to regulations of law; measures for mobilizing forces, materials and vehicles serving natural disaster management to the Minister and organize implementation thereof after being approved;

+ Assist the Minister in directing natural disaster response as prescribed by law;

+ Instruct and inspect the compliance with regulations on emergencies of flood divergence and retardation, measures of evacuation, support and protection for the people;

+ Be responsible for state management of handling river erosion and coastal erosion; bordering rivers, streams and other works serving natural disaster management as prescribed by law;

+ Monitor and update forecasts, warnings and current situations of natural disasters; provide specialized monitoring and supervision devices; respond to climate changes and sea level rise under management of DDMFSC.

- Regarding dyke management:

+ Submit regulations on dyke classification, water levels designed for dykes, load permits and license granting for motor vehicles travelling on dykes; legal documents confirming license granting for operations on special-level dykes, level-I dykes, level-II dykes, level-III dykes; for construction, upgrading of traffic construction works relating to dykes according to regulations of law; dyke-related agreements; documents on appraisal of investment projects on using river islets without existing structures; dyke maintenance and mobilization of forces, materials and vehicles for maintaining dykes, recovering consequences of floods and storms for dykes as prescribed by law to the Minister;

+ Be responsible for state management of investment in constructing, repairing, upgrading, maintaining, solidifying, protecting and using dykes according to regulations of law and assignment and authorization by the Minister.

What are organizational structure of DDMFSC in Vietnam?

Pursuant to Article 3 of the Decision 479/QĐ-BNN-TCCB in 2023 stipulating organizational structure of DDMFSC in Vietnam as follows:

- Leaders of DDMFSC include a Director and Deputy Directors appointed and dismissed by the Minister of Agriculture and Rural Development as prescribed.

+ The Director is responsible for submitting regulations on functions, tasks, powers and organizational structure of DDMFSC to the Minister; promulgating working regulations of DDMFSC; stipulating functions, tasks and powers of advisory organizations of DDMFSC; appointing and dismissing managerial positions of organizations affiliated to DDMFSC according to authorization by the Minister and regulations of law. 

+ The Director shall control operations of DDMFSC, be responsible to the Minister and before the law for operations of DDMFSC. The Deputy Directors shall assist the Director in monitoring and directing certain work aspects according to assignment of the Director; be responsible to the Director and before the law for assigned tasks.

- Advisory organizations:

Advisory organizations of the Vietnam Disaster Management Authority shall be rearranged and reorganized to become division-level organizations under DDMFSC. To be specific:

+ Office of DDMFSC;

+ Department of Planning and Finance;

+ Department of Inspection and Legal Affairs;

+ Department of Science, Technology and International Cooperation;

+ Department of Safety and Disaster Management;

+ Department of Planning and Investment Management;

+ Department of Information and Communications;

+ Department of Community-Based Disaster Management;

+ Department of Dyke Management;

+ Department of Disaster Response and Recovery;

+ Department of Management of Works of Disaster Prevention and Control;

+ Representative Office in the Central Vietnam and Central Highlands of Vietnam;

+ Representative Office in Southern Vietnam.

- Public service providers:

Public service providers under the Vietnam Disaster Management Authority shall continue to operate in accordance with applicable regulations until a decision on improvement and reorganization is issued by a competent authority.
