Pursuant to Point c, Clause 1, Article 3 of Decree 92/2009/ND-CP amended by Clause 6, Article 1 of Circular 03/2021/TT-BNV stipulates regime of increasing salary levels ahead of time as follows:

Salary increase policy ahead of schedule due to excellent achievements in performing tasks:

Method to calculate the number of people who are eligible for a salary increase before the deadline

- For every 10 people on the payroll list (not counting the balance of less than 10 people after dividing the total number of people on the agency or unit's payroll list by 10), the agency or unit is determined to have 01 person received a salary increase ahead of schedule due to excellent achievements.

- Based on the above calculation method, in the fourth quarter of every year, agencies and units (including agencies and units with less than 10 people on the salary list) must submit a written report to the superior management agency to monitor and check the number of people in the rate of salary increase ahead of schedule due to excellent achievements in the following year and the balance is less than 10 people in their agency or unit.

- Direct superior management agencies base on the total number of people on the salary list of less than 10 people (including agencies and units with less than 10 people on the salary list) as reported by agencies. Agencies and affiliated units and the number of people on the salary list are increased during the year by competent authorities in affiliated agencies and units to assign more people to have their salary grade upgraded ahead of time due to outstanding achievements. The number of people in addition to the number of people is not more than 10% of the agency or affiliated unit (with priority given to units with less than 10 people on the salary list and agencies and units that have successfully completed their work tasks), but must ensure that the total number of people whose salary is upgraded ahead of time due to excellent achievements in affiliated agencies and units does not exceed 10% of the total number of people on the salary list as of December 31 of the year of considering salary increase before the deadline of agencies and units under the scope of management.

- By the end of the first quarter of the following year adjacent to the year of consideration for raising salary levels ahead of schedule, if the agency or unit does not implement all the people in the ratio to be raised in salary levels before the deadline of the year considering raising salary levels ahead of schedule (including the number of people assigned by the superior management agency, if any) will not be included in the rate of salary increase before the deadline due to excellent achievements in the following years.

- Fail to make two consecutive salary increases ahead of schedule due to excellent achievements in performing tasks

So according to current regulations, even though you meet the criteria to be considered for a salary increase before the deadline. However, according to regulations in Vietnam, your salary has just been upgraded ahead of schedule. Therefore, the next time your salary cannot be increased before the deadline.

Accordingly, at Point a, Clause 2, Article 2, Circular 08/2013/TT-BNV stipulates criteria for considering salary increases for officials, civil servants and public employees as follows:

a) For officials and civil servants:

- Standard 1: Assessed and graded quality by competent authorities at a level of task completion or higher;

- Standard 2: Do not violate discipline in any of the forms of reprimand, warning, demotion, or dismissal.

b) For public employees and employees:

- Standard 1: Evaluated by competent authorities from the level of task completion upwards;

- Standard 2: Do not violate discipline in any of the forms of reprimand, warning, or dismissal.
