Do police officers who manage HIV-infected inmates in temporary detention centers in Vietnam receive any allowances? Who is responsible for the funding of the allowance for police officers who manage HIV-infected inmates in temporary detention centers in Vietnam? What are the current regulations on HIV prevention in temporary detention centers in Vietnam?

I am currently a police officer working at a temporary detention center and I regularly come into contact with inmates who are HIV-positive. I want to ask if I can enjoy any allowances for this work.

According to Article 2 of Decision 43/2015/QĐ-TTg, the specific beneficiaries are as follows:

Beneficiaries

Head of the sub-camp, Deputy Head of the sub-camp, Head of the sub-zone, Deputy Head of the sub-zone, Head of the sub-division, Deputy Head of the sub-division; Team Leader, Deputy Team Leader and equivalent positions; medical staff, scouts, guards, on-site guards, search, education, teaching, administration, vocational guidance, vocational training, fingerprinting, photography, and identification; staff in charge of managing and exploiting files of prisoners, suspects, inmates, and students; mobile police officers at prisons, temporary detention centers, compulsory education facilities, reform schools, and detention houses; cultural teachers, class teachers in reform schools under the People's Police force who come into contact with HIV-infected individuals.

Pursuant to Article 4 of Decision 43/2015/QĐ-TTg stipulating as follows:

Allowance

1. VND 500,000/person/month, applicable to: Medical staff, scouts, guards, on-site guards, search, education, teaching, administration, vocational guidance, vocational training, fingerprinting, photography, and identification; Mobile police officers at prisons, temporary detention centers, compulsory education facilities, reform schools, and detention houses; Cultural teachers, class teachers in reform schools under the People's Police force.

2. VND 400,000/person/month, applicable to: Head of the sub-camp, Deputy Head of the sub-camp, Head of the sub-zone, Deputy Head of the sub-zone, Head of the sub-division, Deputy Head of the sub-division; Team Leader, Deputy Team Leader and equivalent positions; Police officers who perform other tasks at prisons, temporary detention centers, compulsory education facilities, reform schools, and detention houses.

Based on the information provided, you are eligible for a monthly allowance of VND 400,000 for your work as a police officer who manages HIV-infected inmates in a temporary detention center.

Who is responsible for the funding of the allowance for police officers who manage HIV-infected inmates in temporary detention centers in Vietnam?

Pursuant to Article 5 of Decision 43/2015/QĐ-TTg stipulating the funding of the allowance for police officers who manage HIV-infected inmates in temporary detention centers in Vietnam as follows:

Funding source

The funding source for the allowance specified in Article 4 of this Decision is provided by the state budget in accordance with the provisions of the Law on State Budget.

Therefore, the funding source for the allowance for police officers who manage HIV-infected inmates in temporary detention centers is provided by the state budget in accordance with the provisions of the Law on State Budget 2015.

What are the current regulations on HIV prevention in temporary detention centers in Vietnam?

Pursuant to Article 18 of the Law on HIV/AIDS prevention and control in 2006 (amended by Clause 5 Article 1 of the Law on amendments to the Law on prevention and control of HIV/AIDS in 2020 stipulating as follows:

HIV/AIDS prevention and control at correctional institutions, reform schools, rehabilitation centers, social protection facilities, prisons and detention centers

1. Heads of correctional institutions, reform schools, rehabilitation centers, social protection facilities, prisons and detention centers shall manage, disseminate information and provide counseling, testing, care and treatment for HIV-positive persons, and take measures for preventing HIV infection at their facilities/centers.

2. The Government shall elaborate the management, information dissemination, counseling, testing, caring and treatment of HIV-positive persons, and prevention of HIV infection prescribed in Clause 1 of this Article.

Therefore, the head of the temporary detention center is responsible for organizing the management, propaganda, counseling, testing, care, and treatment of people with HIV and HIV prevention at the facility under their management.

The Government regulates the management, propaganda, counseling, testing, care, and treatment of people with HIV and HIV prevention.
