Disciplinary Action for Communist Party Members Violating Population and Family Planning Policies
According to Article 7 of Regulation 94/QD-TW in 2007 on the handling of disciplinary actions for party members who violate as issued by the Politburo, the content is specified as follows: (This article was amended by Article 1 of Decision 09-QD/TW in 2011)
1- Violating one of the following cases causing minor consequences or violating in the circumstance of having a third child (unless otherwise specified by law) shall result in a reprimand:
a) Obstructing or coercing the implementation of family planning;
b) Producing, trading, importing, supplying counterfeit contraceptive means, those not meeting quality standards, expired, or not yet permitted for distribution and use in Vietnam.
2- In cases of violations that have been disciplined under the regulations in clause 1 of this Article and reoffending, or committing a first-time offense but causing serious consequences, or violating in the circumstance of having a fourth child (except in cases where the law has other provisions), the punishment shall be a warning or dismissal (if holding a position).
3- In cases of violations as specified in clause 1 and clause 2 of this Article, causing very serious consequences or in the circumstance of having a fifth child or more, the punishment shall be expulsion.
